1327.07 DEPOSIT OF BOND REQUIRED; SUSPENSION OF PERMIT; INSPECTIONS.
   (a)   Before proceeding with the construction, enlargement, alteration, repair or removal of any building or other structure, and at the time of securing a permit for such an operation, the owner of such building or structure or his or her agent shall deposit with the Building Commissioner the following amount:

      (1)   These amounts shall be deposited as a guarantee that if any damage is done to a Village road, drainage ditch, sewer line or tile, or tree, or if any debris, dirt or nuisance is deposited on Village streets or property as a result of such operation, the same will be replaced or repaired at the cost and expense of the owner. Upon the failure of the owner to make such repairs or replacements or to cause the removal of debris, dirt or nuisances from Village streets or property, the Building Commissioner shall have such work performed and pay the cost and expense thereof out of the funds so deposited.
      (2)   All funds deposited with the Building Commissioner pursuant to this section, if not expended and not requested for return by the property owner or the agent of the property owner within five (5) years, shall be considered unclaimed funds and shall be forfeited by the depositor and transferred to the Village General Fund in accordance with Section 1327.10.

   (b)   In the event that such cost or expense is incurred and a part or all of the fund is expended for such purpose, the owner or his or her agent shall be required to deposit additional funds necessary to maintain the original amount of the deposit until the work or operation is completed. If the owner or his or her agent refuses to maintain such deposit, the Building Commissioner shall suspend the building permit issued in connection with the work or operation until the deposit is restored to its full original balance. Upon completion of the work or operation, the owner or his or her agent shall notify the Commissioner to make an inspection of the premises to determine whether or not the deposit shall be refunded.
   (c)   If, due to the negligence of the owner, agent, or contractor it becomes necessary to make more than one inspection of such work or operation before authorizing the refund of the deposit, a fee of fifteen dollars ($15.00) shall be charged for each inspection after the first one. After each inspection the Building Commissioner shall make all proper deductions for the cost of replacements, repairs or cleaning up performed by the Village in connection with such work or operation and shall authorize a refund of any balance of such deposit or collect any deficiency from such deposit due.
   (d)   The deposit shall cover any construction involving excavation, grading, filling or the hauling of earth to or from a site for such construction. The Building Commissioner shall cause to be removed all earth, debris or building material which may be placed, left or permitted to remain on any pavement, berm, tree lawn or ditch, or upon any private property in the Village without proper permission, unless the owner or his or her agent promptly causes such earth, debris or material to be removed. The cost of such removal shall be charged against the owner
or his or her agent, as provided in this section. (Ord. 1998-5. Passed 2-11-98.)
   (e)   All funds deposited with the Treasurer pursuant to this section and not expended shall be returned to the owner or the agent of the property owner or transferred to the General Fund in accordance with Section 1327.10.
