§ 93.61  OPEN BURNING REGULATIONS.
   Burning which is permitted with prior written approval of the Town Council, as provided in § 93.60, shall meet the following requirements.
   (A)   Fires shall be attended by at least one adult at all times until the fire is completely extinguished. The Chief of the Fire Department, or in his or her absence, the acting chief or the Town Marshal or his or her designee may require more than one adult to be present at all times as he or she deems necessary.
   (B)   If fires create a nuisance or fire hazard, they shall be extinguished.
   (C)   Only propane gas, wood, or charcoal products shall be burned. No burning which takes place shall involve the utilizations of fuel oil, tires, kerosene, or any other petroleum based material or material which produces black smoke.
   (D)   No burning shall be conducted during unfavorable meteorological conditions such as temperature inversions, high winds, air stagnation, and the like.
   (E)   The provisions of this section notwithstanding, the Chief of the Fire Department, or in his or her absence, the acting chief or the Town Marshal or his or her designee may prohibit any outdoor fires when atmospheric conditions or local circumstances make fires hazardous.
   (F)   All fires shall be subject to any other restrictions or conditions specified by the Chief or acting chief of the Fire Department, or the Town Marshal or his or her designee if deemed necessary for the protection of lives and property within the town, or for the prevention of any hazardous conditions which may endanger the lives or property of others.
