§ 70.99  PENALTY.
   (A)   The fine that shall be imposed upon any person for any moving traffic violation which violates any ordinance or statute of the town shall be $25. This includes, but is not limited to, the offenses of speeding, disregarding automatic traffic signal, disregarding stop or yield signs, passing upon or over a double yellow line, improper lane change, and failure to display turn signal to signify turn.

   (B)   The fine for all parking violations is as follows:
      (1)   First offense shall be $5; and
      (2)   Second and subsequent offenses shall be $10.

   (C)   Where any ordinance does not provide a specific fine amount, the fine shall be $5 for each separate occurrence.

   (D)   An arresting officer has the option of giving a warning ticket instead of a citation for violation to any first time offender, this to depend solely upon the discretion of the arresting officer. There shall be no fine for a warning ticket.

   (E)   Whoever violates or permits or allows anyone to violate § 70.10 shall be fined no less than $1 nor more than $25 for the first violation and for each second and subsequent violation shall be fined no less than $25 nor more than $100; for any second or subsequent violation which shall occur within 365 days of the occurrence of the first violation, to which may be added the following.
      (1)   In the event of the occurrence of the above, the Town Marshal or the Deputy Town Marshal shall give written notice to any such person of such occurrence, and such person shall have 24 hours to move any such vehicle as described in § 70.10.
      (2)   In the event that such person does not move such vehicle as described in § 70.10 within the time limit as provided in division (E)(1) above, the town shall have the right to remove said vehicle, or have said vehicle towed in, and any and all charges incurred by the town for the towing in or moving of same and the storage of same shall be paid by the person so charged, in addition to the fine.
   (F)   Penalty for violating any provision of § 70.11.
      (1)   Any person who violates any provision of § 70.11 shall be deemed guilty of a violation and shall be fined pursuant to the following schedule:
         (a)   First offense in a one-year period: $50.
         (b)   Second offense in a one-year period: $100.
      (2)   Each violation constitutes a separate offense.
      (3)   The certificate of registration for any ORV issued under the provisions of § 70.11 shall be revoked upon the commission of a second violation of § 70.11 within any one-year period.
      (4)   All penalties assessed for violation of § 70.11 shall be paid to the Clerk-Treasurer and deposited into the General Fund of the town, and be made available for appropriation to the operating budget of the Police Department.
