(a) No person shall hunt, kill or attempt to kill any animal or fowl by the use of firearms, bow and arrow, air rifle or any other means within the corporate limits of the Municipality.
(b) Whoever violates this section is guilty of a minor misdemeanor.
(c) Notwithstanding the prohibition of subsection (a) hereof, the hunting of white-tailed deer, Canada geese or wild turkeys by use of a crossbow, long bow or other bow and arrow hunting device, shall be permitted only when all of the following apply:
(1) The person hunting ("the hunter") possesses a current State Hunting License and possesses a current City Damage Control Permit ("Permit"), all of which he/she carries with him/her at all times;
(2) The City has on file all of the necessary documentation required concerning the hunter and the location where the hunter is hunting;
(3) The hunter is on the approved list of hunters maintained by the Mayor with a copy of this list provided to the Chief of the Ontario Police Department;
(4) The hunter is hunting on an approved, registered hunting site, to which all of the following apply:
A. The site consists of a minimum of 10 (ten) contiguous acres of property; and
B. The site includes no individually owned parcel which is smaller, by itself than 5 (five) acres; and
C. The location where the hunter is hunting is on the list of hunting sites registered with the Mayor with a copy of this list provided to the Chief of the Ontario Police Department; and
D. Prior to commencement of any hunting whatsoever, all owner(s) of the hunting site have met with the hunter and fully indicated all boundary lines of the site; and
E. Familiarity with the boundaries of the hunting site shall be the sole responsibility of the hunter; and
F. All hunting activities shall take place on the approved hunting site; and
G. There shall be no pursuit of wounded or killed animals onto other property unless the hunter and/or pursuer have the prior approval of that/those property owner(s).
(5) The hunter shall be a minimum of 8' (eight feet) in the air during all hunting activities;
(6) No hunting for Canada geese shall occur within one thousand (1,000) feet of any residential dwelling unit and no hunting for white-tailed deer or wild turkeys shall occur within five hundred (500) feet of any residential dwelling unit.
(7) Should the hunter want to hunt out-of-season, the hunting under this provision shall occur only upon land for which a Nuisance Wild Animal Permit issued pursuant to Chapter 1501:31-15-08 O.A.C. by the Chief of the Division of Wildlife, Department of Natural Resources, State of Ohio, and in accordance with all provisions of that permit. A copy of this permit shall be filed with the Mayor. The hunter shall also be required to obtain a City Damage Control Permit signed by the Mayor which shall be expire one (1) year from the date of issuance.
(8) Should the hunter only want to hunt in season, the hunter shall only be required to obtain a City Damage Control Permit signed by the Mayor which shall be expire one (1) year from the date of issuance.
(9) Any hunter found to be in violation of any of the above section shall have his or her City Damage Control Permit to hunt in the City terminated immediately. (Ord. 14-68. Passed 1-8-15.)
