If the owner, lessee, agent or tenant having charge of the lands mentioned in Section 557.02 fails to comply with the notice required by such section, the City Zoning Inspector may do either or both of the following:
(a) Issue and serve in the manner provided in Criminal Rule 4 upon the owner, lessee, agent or tenant a complaint and warrant or summons to appear in the Ontario Mayors Court for a violation of Section 557.99;
(b) Cause the noxious weeds to be cut or destroyed or such litter removed and may employ the necessary independent contractor to perform this work or if City Employees are available request that the Service-Safety Director assign this work to employees of the City. All expenses incurred shall be paid out of the City Treasury from money appropriated for this purpose.
