557.99 PENALTY.
      (a)   Whoever violates Section 557.02 of this chapter, upon receipt of written notice of such violation by the Zoning Inspector, the property owner shall be given ten (10) business days to come into compliance with Section 557.02 upon receipt of said notice. Said notice shall be the property owner's only notice for the calendar year and shall only be valid for that calendar year. If the property owner does not bring the property into compliance within ten (10) business days of receipt of the notice of violation, said owner is guilty of a minor misdemeanor.
      (1)   If the property owner has one (1) prior conviction in the calendar year, upon receipt of a second (2nd) written citation of violation in a calendar year of Section 557.02 from the Zoning Inspector, the property owner is guilty of a fourth (4th) degree misdemeanor.
      (2)   If the property owner has two (2) or more prior convictions in the calendar year, upon receipt of each subsequent violation in a calendar year of Section 557.02 from the Zoning Inspector, the property owner is guilty of a third (3rd) degree misdemeanor for each subsequent violation.
   (b)    For purposes of notification under this section, service made in compliance with Civ. R. 4 or Ohio R.C. 1923.04 shall be sufficient prior to commencing an action under this section. (Ord. 19-15. Passed 5-15-19.)
