(a) Official Zoning District Map
(1) The boundaries of the standard zoning districts and overlay zoning districts cited in Section 1135.03, “Establishment of Zoning Districts”, are shown on the Official Zoning Districts Map, City of Ontario, which, together with all notations, references, and other information shown thereon, is hereby adopted by reference and declared to be a part of this Ordinance.
(2) The Official Zoning Districts Map shall be identified by the signature of the Mayor, attested by the City Clerk-Treasurer, under the following words: “This is the Official Zoning Districts Map referred to in Section 1135.02 of the Zoning Ordinance of the City of Ontario,” together with the date of adoption.
(3) If, in accordance with the provisions of this Ordinance, changes are made in the standard zoning district or overlay zoning district boundary lines or other matter portrayed on the Official Zoning Districts Map, such changes shall be made on the Official Zoning Districts Map after the amendment has been approved by the Ontario City Council, together with an entry on the Official Zoning Districts Map as follows:
“On (date), by official action of the Ontario City Council, the following change(s) were made to the Official Zoning Districts Map: (brief description and reference number), which entry shall be signed by the Mayor and attested by the City Clerk.
(4) Amendments to the Official Zoning Districts Map will not become effective until after such change and entry has been made on said map.
(5) No changes of any nature shall be made on the Official Zoning Districts Map except in conformity with the procedures set forth in this Ordinance. Any unauthorized change of whatever kind by any person or persons shall be considered as a violation of this Ordinance and punishable as provided under Chapter 1159.
(6) Regardless of the existence of purported copies of the Official Zoning Districts Map, which may from time to time be published or copied, the Official Zoning Districts Map shall be the final authority regarding the current zoning status of all land, water bodies, buildings and other structures in the . The Official Zoning Districts Map shall be located in a place easily accessible by the public.
(7) In the event that the Official Zoning Districts Map becomes damaged, destroyed, lost, or difficult to interpret, the Ontario City Council may by resolution adopt a new Official Zoning Districts Map which shall supersede the prior Official Zoning Districts Map.
(b) Applicability of Zoning Districts; Effect of Overlay Zoning Districts
(1) All lands within the City of Ontario are located within a standard zoning district or overlay zoning district as shown on the Official Zoning Districts Map or as may be described elsewhere in this Article. Any existing or proposed development on such land within a standard zoning district or overlay district shall be subject to the applicable provisions of this Ordinance.
(2) Where a specific property may be so situated that it lies in two different districts, the regulations and standards of both zoning districts shall be applicable to the development and use of the property. Where specific regulations or standards of a particular property are in conflict, the more restrictive regulation or standard shall apply.
(c) Rules of Interpretation of Zoning District Boundary Lines: Where uncertainty exists with respect to the boundaries of the various districts as shown on the Official Zoning Districts Map, the following rules shall apply:
(1) Boundaries shown as approximately following the centerlines of streets, highways, or alleys, shall be construed to follow such centerlines.
(2) Boundaries shown as approximately following platted lot lines shall be construed as following such lot lines.
(3) Boundaries shown as approximately following the corporation lines of the City of Ontario shall be construed as following the corporation lines.
(4) Boundaries shown as following the centerlines of railroad right-of-way lines shall be construed to follow such centerlines.
(5) Boundaries shown as approximately following the centerlines of streams, rivers, or other bodies of water shall be construed to follow such centerlines.
(6) Where physical or natural features existing on the ground are at variance with those shown on the Official Zoning Districts Map, or in other circumstances are not covered by subsections (a) through (c) above, the City Planning Commission shall interpret the zoning district boundary line.
(d) Zoning of Vacated Areas: Whenever any street, alley or other public right-of-way within the City of Ontario shall have been vacated by action Ontario City Council, and when the lands within the boundaries thereof are attach to and become a part of the lands adjoining such street, alley or public way, such lands formerly within such vacated street, alley or public way shall automatically, and without further action of Ontario City Council, be subject to the same zoning regulations as are applicable to the same district designations permitted under this Ordinance for such adjoining lands.
(e) District Requirements:
(1) Any proposed use of land or structures which is not expressly listed as a permitted use or conditionally permitted use within a zoning district or overlay zoning district, consistent with the zoning regulations established and set forth in this Ordinance, is prohibited.
(2) Any proposed land use density, whether expressed as residential dwelling units per net acre or non-residential square feet per acre, which is not expressly permitted, or not permitted according to conditionally permitted use review criteria, consistent with the district regulations established and set forth in this Article, is prohibited.
(3) No variance shall be granted by the City Planning Commission for a change in the use or density provisions for a property owner. Any modification of use and density requirements may be accomplished only through a rezone amendment of the property in question or an amendment to the applicable use and density provisions of this Article.
