913.10 INDIVIDUAL ASSESSMENT OF ROAD IMPACTS.
   (a)   Any person who initiates development which is required to pay a Road Impact Fee who believes that the actual traffic generation from a proposed project will be less than the projected traffic on which the fee schedule was based, may apply for a determination of an individual road impact fee assessment for the proposed development. The individual road impact fee assessment shall be based on a certified traffic study supplied by developer and/or data presented by the Institute of Transportation Engineers, “Trip Generation” latest edition.
   (b)   Within fifteen working days of receipt of an application for an individual road impact fee assessment, the City Engineer shall determine if the application is complete. If the City Engineer determines the application is not complete, he or she shall send a written statement specifying the deficiencies by mail to the person submitting the application. Until the deficiencies are corrected, the City Engineer shall take no further action on the application.
   (c)   When the City Engineer determines the application for an individual road impact fee assessment is complete, he or she shall, within fifteen working days, review the application, and if the City Engineer determines that the traffic information, traffic factors, and methodology support an individual road impact fee assessment that is acceptable and fairly assesses the fair share of cost of road improvements needed to serve the proposed development, he or she shall issue a determination of individual road impact fee assessment. If the City Engineer determines the traffic information, traffic factors, or methodology are not appropriate, the application for individual road impact fee assessment shall be denied, and the developer shall pay the fair share road impact fee according to the schedule established in Sections 913.09 and 913.10.
