Notwithstanding any provision of this chapter, any person may, at any time, enter into a recapture or other Road Financing Agreement with the City of Ontario providing for financing and construction of road improvement, the repayment of monies expended by the person to construct such roads in excess of the road impact fee due and owing for development proposed by that person out of road impact fees collected. As a part of any such agreement, the City may agree to any approach to payment of road impact fees provided that the total amount of road improvements is not less than the amount that could be constructed with the impact fees calculated according to the fee schedule in Sections 913.09 and 913.10.
