1020.01 PERMIT REQUIRED; FEE; DEPOSIT.
   All street openings, cuttings or tunnelings shall be made only under the following conditions:
   (a)   No person shall make any excavation, trench, tunnel or other opening in any street or other public right-of-way in the City, without first obtaining a permit to do so from the City.
   (b)   A fee in accordance with Section 1448.03 shall be paid by the applicant to cover the expense of issuance of the permit and related material, with the exception that the permit fee for lawn sprinkler systems in the public right-of-way shall be as stated in Section 1448.03. 
   (c)   In addition to the fee set forth in subsection (b) hereof, or in Section 1448.03, the applicant, as a further condition to the issuance of a permit, shall deposit with the City the amount or amounts indicated as set forth in Section 1448.95.
Such deposit, less any cost incurred by the City in connection with repair of the openings (and including charges made by the City Engineer for inspection, etc.) shall be refunded to the applicant after the street or other public right-of-way has been resurfaced or returned to its original condition and approved by the Service Director.
   (d)   In no event shall a permit be issued for the making of an opening, excavation, tunnel or cut where the same would or might hamper use of the street or other public right-of-way by the public or create a serious traffic or other hazard.
   (e)   The issuance of a permit shall be deemed acknowledgment by the recipient as to the rules and regulations governing work within public right-of-ways within the City, as established by the City. The Mayor or the Service Director may waive said permit and deposit for maintenance and repair purposes. All new construction requires permits.
   (f)   For purposes of this section, "applicant" means the person or persons performing the work described in the permit required.
