(a) Except as otherwise provided in Section 240.055(c), an employee of the Police Department, other than the Chief, assigned to duty by his or her supervisor for more than one-half of his or her usual shift on New Year’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day or Christmas Day, shall be entitled to compensation for the hours spent on duty on each of those days at a rate of one and one-half times his or her base salary rate calculated by dividing the annual salary by the total number of working hours per year. Such total number of regular working hours per year is 2,080. In addition to such premium pay, the employee shall receive an additional day off during what would otherwise be his or her usual shift duty on another non-holiday day, to be mutually agreed upon between the employee and his or her supervisor.
The Chief of Police, if assigned to duty for more than one-half of his or her usual shift day on New Year’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day or Christmas Day, shall be entitled to an additional day off during what would otherwise be his or her usual shift duty on another non-holiday day, to be mutually agreed upon between the employee and his or her supervisor.
(b) Any employee of the Dispatcher Division, assigned to duty by his or her supervisor for more than one-half of his or her usual shift day on New Year’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day or Christmas Day, shall be entitled to compensation for the hours spent on duty on each of those days at a rate of one and one-half times his or her base salary rate calculated by dividing the annual salary by the total number of working hours per year. Such total number of regular working hours per year is 2,080. In addition to such premium pay, the employee shall receive an additional day off during what would otherwise be his or her usual shift duty on another non-holiday day, to be mutually agreed upon between the employee and his or her supervisor.
(c) Except as otherwise provided in Section 242.081, each employee of the Fire Department, covered in this chapter, shall be entitled to four shift days of twenty-four hours each per year as holiday leave time, to be scheduled at a time mutually agreed upon by the employee and his or her supervisor.
(d) Employees of the Streets Department (within the Service Department) shall be entitled to the following six paid holidays: New Year’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and Christmas Day. Such holidays shall be observed on the recognized date during the work week. If the holiday falls on a Saturday, the Friday preceding the holiday shall be considered the holiday, and if the holiday falls on a Sunday, the following Monday shall be considered the holiday, except under emergency circumstances. The City shall determine, at its sole discretion, whether or not emergency conditions apply. If an employee, under emergency conditions, is called to work on such day, then the rate of compensation for such day shall be twice his or her base salary rate. In addition, such employees shall be entitled to an additional four hours of holiday time to be used exclusively on Christmas Eve when Christmas Day falls on Tuesday through Friday, inclusive, of any given year. Should an employee be called back to duty during this time, he or she shall be compensated for salary purposes at the rate of one and one-half his or her normal rate of pay.
The provisions set forth in this subsection shall also apply to the Service Supervisor and Assistant Service Supervisor.
(e) Employees of the Building Department (within the Service Department) shall be entitled to the following six paid holidays: New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and Christmas Day. Such holidays shall be observed on the recognized date during the work week. If the holiday falls on a Saturday, the Friday preceding the holiday shall be considered the holiday, and if the holiday falls on a Sunday, the following Monday shall be considered the holiday.
(f) All classified employees, except employees of the Fire Department, shall be entitled to three additional days off per year not otherwise specified in this section, at a time mutually agreed upon by the employee and his or her supervisor. Further, employees may accumulate additional holiday leave at the rate of one-fourth day for each month worked without using any sick leave credit, but not more than three full days may be accumulated in any given year.
Employees of the Fire Department, including the Chief of Fire, shall be entitled to one additional shift day off per year not otherwise specified in this section, at a time mutually agreed upon by the employee and his or her supervisor, which shall be designated a personal leave day. Further, employees may accumulate additional holiday leave at the rate of one-half day per two- month period worked without using any sick leave credit in that period, but not more than three full shift days may be accumulated in any given year.
Such additional holiday leave may only be taken in full work days, at a time mutually agreed upon between the employee and his or her supervisor, except for members of the Service Department, who shall be entitled to leave in increments less than a full work day at the discretion of the Service Supervisor. All full days accumulated and not used by March 15 of the following year shall be lost to the employee and cannot be carried to any succeeding year. Any fractional time remaining unused at the end of each year, that is less than a full day, shall be reimbursed to the employee by the City as additional salary, according to the salary schedule for each employee.
(g) If, during a calendar year, any employee of the Police Department or the Dispatcher Division is not assigned to duty on any one of the six holidays specified in subsections (a) and (b) hereof, the employee shall be entitled to an additional non-holiday day off for each such holiday on which the employee is not assigned to duty, at a time mutually agreed upon between the employee and his or her supervisor.
