SECTION 9.04. SAFETY DEPARTMENT.
   The Safety Department shall consist of two divisions which shall be known as the Police Department and the Fire Department.
   (a)   Safety Director. The Safety Director shall be the head of the Safety Department and shall be responsible for the enforcement of all police, fire, health, safety, and sanitary regulations that may be prescribed by resolutions and ordinances of this Municipality or by the laws of Ohio. The Safety Director shall make and publish, with the approval of Council, written rules for the government of the Police and Fire Departments and for the conduct and discipline of members thereof.
The Mayor, in addition, to his other duties, shall be, and shall perform the duties of, the Safety Director, until such time as Council may determine that it is in the best interest of the Municipality to appoint some other person to that office. Upon making such determination, Council shall declare the office of Safety Director vacant, and the Safety Director shall then be appointed by the Mayor as provided in Section 4.03 of this Charter.
   (b)   Police Department. The Police Department shall consist of a Police Chief and such other officers, patrolmen, and personnel as Council may deem advisable. The position of Police Chief shall be subject to the Civil Service provision of this Charter, Section 10.05, and the Mayor shall appoint a Police Chief from those individuals eligible for such position in accordance with the Civil Service Rules.
   (c)   Fire Department. The Fire Department shall consist of a Fire Chief and such other officers, firemen, and personnel as Council may deem advisable. The department shall be responsible for fire suppression, fire prevention, fire investigation and Emergency Medical Services (EMS). The position of Fire Chief shall be subject to the Civil Service provisions of this Charter, Section 10.05, and the Mayor shall appoint a Fire Chief from those individuals eligible for such position in accordance with the Civil Service Rules.
