§ 50.115 HAZARDOUS WASTE DISPOSAL FACILITY.
   A person seeking a hazardous waste disposal facility permit must first establish compliance with the Comprehensive Zoning Ordinance. Upon compliance being established, a hazardous waste disposal facility permit application shall be submitted to the Coordinator setting forth the following information:
   (A)   Statement of the exact nature and source of the materials to be disposed of at the subject property.
   (B)   A site plan showing the following:
      (1)   The entire property, principal structures, accessory buildings, and paved areas;
      (2)   All natural or historic features including, but not limited to, streams, topography, cemeteries, and endangered species habitats;
      (3)   Methods employed to control surface drainage, illegal dumping, and fires; and
      (4)   An operations plan which includes record keeping, reporting, location, containment, sortation, and disposal of materials.

§ 50.116 LANDFARMING FACILITY.
   A person seeking a landfarming facility permit must first establish compliance with the Comprehensive Zoning Ordinance. Upon compliance being established, a landfarming facility permit application shall be submitted to the Coordinator setting forth the following information:
   (A)   Statement of the exact nature, degree of contamination, and source of the soil to be treated on the subject property.
   (B)   A site plan showing the following:
      (1)   The entire property, principal structures, accessory buildings, location of soil treatment, and paved areas;
      (2)   All natural or historic features including, but not limited to, streams, topography, cemeteries, and endangered species habitats;
      (3)   Methods employed to control surface drainage, and illegal dumping; and
      (4)   An operations plan which includes record keeping, reporting, containment procedures, capacity assurance, and closure procedures.

PERMITS
§ 50.130 PERMIT REQUIREMENTS.
   No person or entity shall engage in the business of collection, transporting, disposal, storage, or processing of solid waste generated within the county without a permit secured from the local, state, or federal agency which oversees said waste.

§ 50.131 PERMIT PROCEDURE.
   Prior to issuance of a permit to collect, transport, dispose of, store, or process solid waste generated within the county, an application must be completed and submitted with the permit fee to the local, state, or federal agency which oversees said waste.

§ 50.132 PERMIT ISSUANCE.
   If the application shows that the applicant will collect, transport, store, and/or process solid waste without hazard to the public health or damage to the environment and in compliance with the laws of the federal government, the State of Kentucky, the Comprehensive Zoning Ordinance, and this chapter, the local, state, or federal agency which oversees said waste may issue the appropriate permit. If modifications are necessary to the application regarding service, equipment, reporting of activity, or mode of operation so as to bring the application into compliance, the local, state, or federal agency which oversees said waste shall notify the applicant in writing, setting forth the modification to be made and the time in which it shall be done.

§ 50.133 APPLICATION DENIAL.
   If the applicant does not make the modifications pursuant to the notice in § 50.132 within the time limit specified therein or if the application does not clearly show that the collection, transportation, storage, or processing of solid waste will not create a public health hazard or be without harmful effects on the environment, the permit application shall be denied in writing, stating the reason for such denial. Nothing in this section shall prejudice the right of the applicant to reapply after the rejection of his or her application, provided that all aspects of the reapplication comply with the provisions of this chapter. Nothing in this section shall prevent the denial of a permit should the total number of annual permits as determined within the Comprehensive Zoning Ordinance have already been issued.

§ 50.134 PERMIT DISPLAY.
   All motor vehicles operating under any permit required by this chapter shall maintain a copy of said permit in the vehicle. Each permit for processing or disposal facilities shall be prominently displayed at the facility.
