§ 113.10 FCC PERMITS AND TIME OF CONSTRUCTION.
   (A)   The franchisee shall make proper application to the Federal Communication Commission for all permits, licenses or approvals required by law for the construction and operation of the CATV system, at the franchisee’s expense.
   (B)   Further, the franchisee shall adhere to the following time schedules.
      (1)   The franchisee shall comply with all of the procedural requirements of the FCC. The franchisee shall notify all necessary parties including the FCC, within 30 days following the effective date of the ordinance awarding a franchise hereunder of its intent to operate a cable communication system and shall begin construction of the system within 60 days after receiving FCC approval, and execution of the necessary pole attachment agreements with all utility companies providing service in the county. If for any reason the franchisee has not notified all parties within 30 days, then the franchise shall be considered null and void. Within six months of receipt of the necessary FCC permits and utility pole attachment agreements, the franchisee shall install 25% of the coaxial cable required to make available CATV service to the service area.
      (2)   Within 18 months after the obtaining of FCC approval and execution of the utility pole attachment agreements, the franchisee shall have achieved 90% completion of the construction necessary to make CATV service available to the service area.
      (3)   Failure to install cable in accordance with the construction timetable as provided herein shall constitute a violation of this chapter and shall subject the franchisee to all of the penalties and remedies prescribed in this chapter.
