The following definitions shall apply:
AGENT: A person acting on behalf of another with authority conferred, either expressly or by implication.
BRIBE: Signifies any money, goods, rights in action, property, thing of value, or advantage, present or prospective, or any promise or undertaking to give any, asked, given, or accepted, with a corrupt intent to influence unlawfully the person to whom it is given in his action, vote, or opinion in any public or official capacity.
CHARTER AND CITY CHARTER: The Council-Manager Charter of Ogden City adopted June 29, 1951 and repealed, effective January 6, 1992, at twelve o'clock (12:00) noon.
CITY: The City of Ogden, located in the County of Weber, State of Utah.
CITY COUNCIL AND COUNCIL: Unless otherwise indicated, the City Council of Ogden City.
CODE: The Ogden Municipal Code.
CORRUPTLY: Imports a wrongful design to acquire or cause some pecuniary or other advantage to the person guilty of the act or omission referred to, or to some other person.
COUNTY: The County of Weber, State of Utah.
COUNTY HEALTH DEPARTMENT: The Weber-Morgan District Health Department, or its successor.
KNOWINGLY: Knowledge that the facts exist which bring the act or omission within the provisions of this Code. It does not require any knowledge of the unlawfulness of such act or omission.
LAND, REAL ESTATE AND REAL PROPERTY: Includes land, tenements, hereditaments, water rights, possessory rights and claims.
LAW: Any of the constitutions, statutes, regulations, or court decisions of the United States of America or the State of Utah or ordinances of Ogden City, Utah.
MALICE AND MALICIOUSLY: Imports a wish to vex, annoy or injure another person, or an intent to do a wrongful act, established either by proof or by presumption of law.
MAYOR: The duly-elected or appointed Mayor of Ogden City, Utah, and shall include any person or persons designated by the Mayor to act in the Mayor's stead, unless the context clearly indicates that the Mayor, as an individual person, is intended.
MONTH: A calendar month unless otherwise expressed, and the word "year", or the abbreviation "A.D." is equivalent to the expression "year of our Lord".
NEGLECT, NEGLIGENCE, NEGLIGENT AND NEGLIGENTLY: Imports a want of such attention to the nature or probable consequences of the act of omission as a prudent man ordinarily bestows in acting in his own concern.
OATH: Includes "affirmation", and the word "swear" includes "affirm". Every mode of oral statement under oath or affirmation is embraced in the term "testify", and every written one, in the term "depose".
OCCUPANT: As applied to a building or land, shall include any person who occupies the whole or any part of such building or land whether alone or with others.
OWNER: As applied to a building or land, shall include any part owner, joint owner, tenant in common, joint tenant or lessee of the whole or of a part of such building or land.
PEACE OFFICER: Means "law enforcement officer", as defined in Utah Code Annotated section 53-10-103, as amended.
PERSON: Means and includes individuals, bodies politic and corporate, partnerships, associations and companies.
PERSONAL PROPERTY: Means and includes every description of money, goods, chattels, effects, evidences of rights in action, and all written instruments by which any pecuniary obligation, right, or title to property is created, acknowledged, transferred, increased, defeated, discharged, or diminished, and every right or interest therein.
PROPERTY: Means and includes both real and personal property.
SIGNATURE: Means and includes any name, mark or sign written with the intent to authenticate any instrument or writing.
STATE: The State of Utah.
STREET: Includes alleys, lanes, courts, boulevards, public ways, public squares, public places and sidewalks.
TENANT: As applied to a building or land, shall include any person who occupies the whole or any part of such building or land, whether alone or with others.
WILFULLY: A purpose or willingness to commit the act or make the omission referred to. It does not require any intent to violate law, or to injure another, or to acquire an advantage.
WRITING: Means and includes printing, writing and typewriting.
