17-5-4: PETITION FOR INJUNCTIVE RELIEF AND CIVIL PENALTIES:
   A.   The commission may file a request with the city attorney to file a petition for injunctive relief to compel the owner to repair the significantly deteriorating historic resource undergoing demolition by neglect, to seek civil penalties to penalize the owner from ongoing violation of the law, and to deter other owners from failing to repair or maintain. The petition may be filed only by the Ogden City attorney.
   B.   This chapter does not create a private right of action or any right or remedy that is the same or substantially equivalent to the remedies provided under federal or state law.
   C.   This chapter requires compliance with any federal or state standards when the city is engaged in any project funded by the federal or state government to promote the preservation and protection of any historic resource in Ogden City.
