(a) No person shall keep or harbor any cows, horses, sheep, swine, goats or other livestock, or poultry or fowl within the corporate limits of the Municipality, with the exception of animal or poultry husbandry in conformance with the provisions of Section 1163.02
(b) of the Codified Ordinances.
(b) Whoever violates this section is guilty of a minor misdemeanor on a first offense and a fourth degree misdemeanor for each subsequent offense. In the event that the animal creates a risk of or causes physical harm to persons or property, the person shall be guilty of a fourth degree misdemeanor on a first and any subsequent offense. Each day during which such violation continues shall constitute a separate offense.
(c) Exemption. The Administrator may issue an exemption from the requirements of Section 505.13
(a) for horses, sheep, goats, poultry or other fowl under the following circumstances:
(1) Minimum property size: The property is a minimum of 1.5 acres;
(2) Limits on number permitted: No more than three horses, sheep, or goats in total are permitted and no more than fifteen chickens including roosters.
(3) Location: Animals must be kept to the rear of the property. Any cages or enclosures cannot be located in the front or side yards.
(4) Nuisance: The Administrator has determined that the animals would not create a nuisance for surrounding property owners.
(5) Revoking an exemption: The Administrator may, at his/her sole discretion, revoke the exemption immediately should the above criteria be violated. (Ord. 18-13. Passed 4-22-13.)
