As used in this chapter:
(a) "Vehicle" has the same meaning as set forth in Ohio Revised Code Section 4501.01(A)
(b) "Motor Vehicle" has the same meaning as set forth on Ohio Revised Code 4501.01(B)
(c) "Operator" has the same meaning as set forth in Ohio Revised Code 4501.01(X).
(d) "Low Speed Vehicle" has the same meaning as set forth in Ohio Revised Code 4501.01(WW).
(e) "Under Speed Vehicle" has the same meaning as set forth in Ohio Revised Code 4501.01(XX). Golf carts are considered under speed vehicles.
(f) "Street" and "Highway" have the same meanings as set forth in Ohio Revised Code 4501.01(AA). (Ord. 11-19. Passed 5-13-19.)
(a) No person shall operate a golf cart on the streets within the Village of Obetz unless the golf cart has first passed an inspection by the Chief of Police or designee for compliance with the State of Ohio's requirements that are applicable to motor vehicles and such golf cart contains all equipment required by this chapter.
(b) A list of equipment required for safe operation in accordance with Ohio Revised Code Chapter 4513 shall be maintained at the Obetz Police Department and shall include:
(1) Adequate brakes and braking system;
(2) Properly working brake lights, head lights, tail lights, and turn signals;
(3) A properly working steering mechanism;
(4) A windshield made of glass or safety glass;
(5) A rearview mirror;
(6) A working horn, audible from not less than 200 feet;
(7) A child safety seat for any occupant under the age of four or under forty (40) pounds in weight;
(8) Front and rear license plates and a license plate light to make the rear plate legible from a distance of fifty (50) feet; and
(9) Seatbelts for the driver and all passengers.
(c) If the golf cart passes inspection, the Chief of Police shall issue the owner or operator a Certificate of Compliance entitling the owner or operator to operate the golf cart on the streets within the Village of Obetz. The owner or operator shall also show proof of financial responsibility. The Certificate of Compliance is good for two years from the date of issuance. The Chief of Police shall keep a copy of each Certificate issued. A copy of the Certificate shall be kept on the golf cart at all times.
(d) The owner of a golf cart shall also comply with all requirement of Ohio law regarding proper title, registration and license plates prior to operating a golf cart on any Village street.

(a) No golf carts shall be permitted to travel on any Village street where the speed limit is greater than twenty-five (25) miles per hour.
(b) This section does not prohibit a person from proceeding across an intersection of a street provided the speed limit on the street that will be crossed is no greater than thirty-five (35) miles per hour and at no time shall golf carts be permitted to cross any section of Alum Creek Drive or the sections of Groveport Road where the speed limit is over thirty-five (35) mph.
(c) Occupants of golf carts shall be seated at all times on the seat of the golf cart buckled by the seat belt when the golf cart is on and in motion. Standing on any portion of the golf cart while it is in motion is prohibited.
(d) No person shall operate a golf cart on sidewalks or bike paths.
(e) Operator must hold a valid, current motor vehicle driver's license.
(f) Golf carts are the only low speed or under speed vehicles permitted to operate on Village streets provided the requirements of this Chapter are met.

Whoever violates this Chapter is guilty of a minor misdemeanor. If within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this Chapter is guilty of a misdemeanor of the fourth degree. If within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this Chapter is guilty of a misdemeanor of the third degree.
