5.03 VACANCY, TEMPORARY ABSENCE OR DISABILITY.
   (A)   If the office of Mayor shall become vacant, the President Pro Tem of Council shall have the option to succeed to the office of Mayor. If the President Pro Tem of Council fails to accept the succession to the office of Mayor within five days after he or she receives notice of the vacancy, the Council shall elect another member of the Council to serve as the Mayor for the remainder of the unexpired term.
   (B)   If the Mayor is temporarily absent from Obetz or is temporarily unable to perform the duties of Mayor, the President Pro Tem of Council shall become the Acting Mayor and shall, during the period of absence or disability, perform all the powers, duties and functions of Mayor. The Acting Mayor shall continue in his or her capacity as President Pro Tem of Council and as a voting member of the Council during the period of the Mayor's temporary absence or disability. While acting as Mayor, the President Pro Tem of Council shall not remove or appoint officials or employees of Obetz unless the Mayor is absent or unable to perform his or her duties for a period of at least 30 days; provided that, in the case of urgent necessity defined in an ordinance or resolution with all of the members of Council concurring, the President Pro Tem of Council, as Acting Mayor, may remove or appoint officers or employees of Obetz as provided in the ordinance or resolution.
