(a) Any person, company or industry that violates or fails to comply with a provision of this chapter, other than provisions applicable to officials or employees of the Village of Obetz, shall be prosecuted within the limits provided by state and local laws. Each day that a violation continues after due notice has been served shall be deemed a separate offense. Violations shall be classified as a misdemeanor of the fourth degree. Whoever violates any provision of this chapter shall be subject to the penalties prescribed in Section 501.99, except for the violations as outlined in Chapter 1145 of the Columbus City Code. In addition thereto, such person, company or industry shall be liable to the Municipality or City for any expense, loss or damage occasioned by reason of such violation.
(b) Prior to the application of any of the prescribed penalties, the person, company or industry found in violation will be notified in writing, by the Administrator, advising of the violation and the necessary action to be taken. The person, company or industry will be granted a period of time, as determined by the Administrator, in which to effect remedial measures. Thereafter, the person, company or industry will be on notice that further violation shall be immediately subject to the prescribed penalties.
