1142.01 PURPOSE.
   The Old Town Residential District (R-3) is provided for the oldest residential neighborhood in Obetz, which contains a variety of homesites comprised of various configurations based on original platted lots which fail to meet the current development approaches. The R-3 District is intended to protect and preserve the existing neighborhood and encourage reinvestment by providing uniform and flexible development standards. The R-3 district shall not be for rezoning applications. (Ord. 38-04. Passed 10-11-04.)
1142.02 PERMITTED USES.
   (a)    Single-family Residence. There shall be no more than one principal structure per lot.
   (b)    Public and Private Schools. Public or private schools offering general educational courses and having no rooms regularly used for housing or sleeping of students.
   (c)    Parks. Open spaces, playgrounds, and other related program elements and park features intended to provide for passive amenities to the immediate or surrounding neighborhoods, while limiting site impacts.
1142.03 ACCESSORY USES AND STRUCTURES. (REPEALED)
   EDITOR’S NOTE: Former Section 1142.03 was repealed by Ordinance 37-13.
1142.04 CONDITIONAL USES.
   The following uses shall be allowed in the R-3 District subject to the approval of a Conditional Use permit in accordance with Chapter 1181.
   (a)    Child Daycare Center. A kindergarten or a child daycare facility as an Accessory Use of a dwelling or as a Principal Use of the lot, provided there shall be an outdoor play area of 200 square feet or more per child. Such play area shall be arranged in accordance with the provisions of this district for Accessory Uses, and shall be enclosed with a sturdy and protective fence with a height of four feet, but not more than six feet. The building occupied by the use must be compatible with neighborhood structures in dimension, size, and architecture. A drop off area must be provided so that children do not have to walk through the parking lot to enter the facility.
   (b)    Churches and Other Similar Places of Worship and Parish Houses. Provided said use occupies a lot of not less than one (1) acre. The minimum lot width is one hundred (100) feet. The lot is adequate to accommodate 50 percent of the required off-street parking requirements of Chapter 1169. The church building is set back from any adjacent residential property line a distance equal to or greater than the height of the structure exclusive of the steeple or spire. The location, density, and the additional lot area required for such uses shall be subject to approval by the Planning and Zoning Commission. Accessory recreational uses may be provided on the church lot as a conditional use subject to approval by the Planning and Zoning Commission.
   (c)    Assisted Living Facilities. (Ord. 10-07. Passed 5-14-07.)
1142.05 DEVELOPMENT STANDARDS.
   In addition to the provisions of Chapter 1165, the following standards for the arrangement and development of land and buildings are required in the R-3 District:
   (a)    Minimum Lot Area. 5,000 square feet for a single family home.
   (b)   Minimum Lot Width. Fifty (50) feet.
   (c)    Minimum Front Yard. Fifteen (15) feet as measured between the street right-of- way line and the building setback line.
   (d)    Minimum Side Yard. Five (5) feet as measured from the side property line.
   (e)    Minimum Rear Yard. Fifteen (15) feet as measured from the rear property line.
   (f)    Maximum Lot Coverage. No lot shall be covered more than thirty-five percent (35%) by the structure.
   (g)    Minimum Dwelling Structure Size. No dwelling unit shall have a minimum total floor area of less than 850 square feet.
   (h)    Maximum Height of Principal Structure. Thirty-five feet.
   (i)   Basements Required. All single family structures shall have basements.
