A plat or portion thereof may be vacated. The owner or owners of properties located within the area of the plat proposed to be vacated shall submit to the Planning Commission a document, which shall include a text and/or drawings in form approved by the Law Director, declaring said plat or portion thereof vacated.
If the vacation does not involve the vacation of a public right-of-way, easement, or other public property, the Planning Commission shall take action to approve, approve with conditions, or disapprove such document of vacation. The action of the Commission shall be final.
If the vacation involves the vacation of a public right-of-way, easement, or other public property, the Planning Commission shall make a recommendation to City Council. Council may approve, approve with conditions, disapprove, or approve in part any such document.
Upon approval by the Planning Commission or City Council, said document shall be recorded in like manner as plats of subdivisions and shall operate to destroy the force and effect of the plat, or portion thereof, so vacated.
