1319.01 EXCEPTIONS FOR HARDSHIP; PUBLIC HEARING.
   A subdivider may file a written request to the Planning Commission for exceptions to the provisions of this Subdivision Ordinance, specifying the hardships imposed by the provisions and the nature of the exceptions requested.
   The Planning Commission shall hold a public hearing on the request and shall notify all abutting property owners of the date, place and purpose of the public hearing.
   After hearing those who wish to present evidence, the Planning Commission may, where it finds that extraordinary and unnecessary hardship may result from strict compliance with these regulations as a result of site conditions, vary or waive the provisions of this Ordinance so as to relieve the hardships provided that:
   (a)   The request is consistent with the intent of this Subdivision Ordinance;
   (b)   The public interest will not be adversely affected;
   (c)   The abutting property owners will not be adversely affected.
   In granting such exceptions, the Planning Commission may require such conditions as will, in its judgement, secure substantially the objective of the provisions so excepted.
