For the purpose of this title, certain terms and words are hereby defined. Words used in the present tense shall include the future; the singular number shall include the plural and the plural the singular; the word "shall" is mandatory and is not directory, and the word "person" includes firm, association, trust, organization, partnership, company or corporation as well as an individual. Unless otherwise stated, the requirements of this title are minimum requirements.
Where there is no definition or category which fits a proposed use or new or innovative idea, the proposed use shall be considered a "special use" and shall comply with the provisions of chapter 14 of this title.
ACCESSORY BUILDING: A subordinate building or portion of the main building, the use of which is incidental to that of the main building or to the principal use of the premises, including garages, fallout shelters, storage sheds, storage buildings and swimming pools (but only to the extent any such swimming pool is completely covered in such a way that rainwater cannot enter the swimming pool).
ACCESSORY USE: A use which is incidental to the principal or main use of the premises.
ADDITION: An extension or increase in floor area or height of a building or structure.
ALLEY: A public or private thoroughfare which affords only a secondary means of access to property abutting thereon.
ALTERATION: Applied to a building or structure to mean a change or rearrangement in the structural parts or in the exit facilities.
APARTMENT: A room or suite of rooms in a multiple- or two-family dwelling, or where more than one living unit is established above nonresidential.
APARTMENT HOUSE: See definition of Dwelling, Multiple-Family.
ATTIC: A space between the roof and the next lower ceiling, having an average clear height of less than seven feet (7').
AUTOMOBILE SERVICE STATION: Any building or premises used for the dispensing, sale or offering for sale at retail of any automobile fuels or oils. When the dispensing, sale or offering for sale is incidental to the conduct of a public garage, the premises are classified as a public garage.
BASE FLOOD ELEVATION: See title 6, chapter 14 of this code.
BASEMENT: A story having more than one-half (1/2) its height below the grade. A basement shall not be counted as a story for the purpose of height.
BOARDING HOUSE: See definition of Lodging House.
BUFFER: A zone, area or strip used to separate uses or to serve as a protective barrier between uses. For the purpose of this title, there are three (3) types of buffers:
A. Buffer zone: Area used to separate uses.
Example: An area used to develop distance or barriers between a shopping center and an R-1 area.
B. Transitional zone: An area which gradually decreases intensity of use.
Example: Decreasing from a commercial use to a multi-family use to a single-family use. The reduction may be in height, bulk and density.
C. Buffer strip: A narrow strip of land used for the erection of a barrier or landscaping where areas of different zoning are contiguous.
Example: A landscaped and fenced area where a commercial zone abuts a residence zone.
BUILDING: See definition of Structure.
BUILDING, HEIGHT OF: The vertical distance measured from the established grade for the building to the highest point of the roof for flat roofs; to the deck line for mansard roofs; and to the mean height level (between eaves and ridge) for gable and hip roofs.
CELLAR: See definition of Basement.
COMMUNITY BUILDINGS: Any building used as a place of public assembly which is of a public or quasi-public nature, which would qualify as a real estate tax exempt structure.
COMMUNITY RESIDENCE: A group home or specialized residential care home serving unrelated persons with disabilities. Community residence does not include a residence which serves persons as an alternative to incarceration for a criminal offense.
CONVALESCENT, NURSING OR REST HOME: A public or private facility for the care of children, adults, aged or the infirm or a place of residence, permanent or temporary, for those suffering mental and physical disorders, but not including facilities for surgery or contagious diseases.
DEVELOPMENT: Any use for a parcel of land which proposes to construct, reconstruct or modify the building(s) occupying the land, or which proposes to place a building on a parcel of land. Development implies a process in which details are set forth in an orderly manner to evolve the possibilities of the land and/or buildings in a manner compatible with the growth of the community, and the objectives of planning and zoning of the village of Oak Lawn.
DISTRICT: A section or sections of the village of Oak Lawn for which the regulations governing the use, height and bulk of buildings and premises are uniform.
DUPLEX: See definition of Dwelling, Two-Family.
DWELLING: A building, or portion thereof, but not a trailer or mobile home, designed or used exclusively for residential occupancy, including single-family dwellings, two-family dwellings, and multiple-family dwellings, but not including hotels, motels or lodging or boarding houses.
DWELLING, ATTACHED: A dwelling which is joined to another dwelling at one or more sides of a party wall or walls. (See definition of Row House, Townhouses.)
DWELLING, DETACHED: A dwelling which is entirely surrounded by open space on the same lot.
DWELLING, MULTIPLE-FAMILY: A building, or portion thereof, containing three (3) or more dwelling units.
DWELLING, SINGLE-FAMILY: A building containing one dwelling unit only.
DWELLING, TWO-FAMILY: A building containing two (2) dwelling units only.
DWELLING UNIT: Consists of one or more rooms which are arranged, designed or used as living quarters for one family only.
EFFICIENCY UNIT: A dwelling unit consisting of one principal room exclusive of bathroom, kitchen, hallway, closets or dining alcove directly off the principal room, providing such dining alcove does not exceed one hundred twenty five (125) square feet in area.
FAMILY: One or more persons occupying a premises and living as a single housekeeping unit, with one kitchen constituting the cooking facilities for the unit, whether or not related to each other by birth, adoption or marriage; provided, however, that:
A. No unit consisting of all unrelated persons shall exceed three (3) persons; and
B. No unit consisting of related and unrelated persons shall consist of more than the related family and no more than two (2) other unrelated persons.
FARM: An area which is used for the growing of the usual farm products such as vegetables, fruit, trees and grain and their storage on the area, as well as for the raising thereon of the usual farm poultry and farm animals for the use or consumption of the person or persons operating the farm. The term farming includes the operating of such an area for one or more of the above uses, including the necessary accessory uses for treating or storing the produce; provided, however, that the operation of such accessory uses shall be secondary to that of the normal farming activities; and provided further, that farming does not include the feeding of garbage or offal to swine or other animals.
FLOOD RESERVOIR: A manmade ponding area created for the purpose of impounding floodwaters to alleviate any flood damage to the surrounding buildings and area.
FLOODPLAIN: That continuous land area adjacent to a watercourse whose elevation is equal to or below the flood base elevation, including any land which is surrounded on more than one-half (1/2) its perimeter by land having an elevation equal to or lower than the flood base elevation. (Also known as the "flood hazard area".) See title 6, chapter 14 of this code.
FLOOR AREA FOR DETERMINING FLOOR AREA RATIO: The floor area of a building is the sum of the gross horizontal areas of all of the floors of the building measured from the exterior faces of the exterior walls or from the centerline of walls separating two (2) buildings. The floor area when more than one-half (1/2) of the basement height is above the established curb level or above the finished lot grade level where the curb level has not been established; elevator shafts and stairwells; floor space used for mechanical equipment except equipment located on the roof; attic space having headroom of seven feet (7') or more; interior balconies and mezzanines and enclosed porches and floor areas devoted to off street parking or loading for commercial use shall not be included in the floor area. This definition shall not apply if there is a specific floor area definition included in specific regulations such as planned unit development, planned office and commercial, planned multiple-floored residential or other such ordinances or regulations which may be developed in the future.
FLOOR AREA FOR DETERMINING OFF STREET PARKING AND LOADING REQUIREMENTS: Floor area when prescribed as the base of measurement for off street parking spaces and loading berths or any use shall mean the sum of the gross horizontal areas of all of the several floors of the building or portions thereof. This definition shall not apply if there is a specific floor area definition included in specific regulations such as planned unit development, planned office and commercial and planned multiple-floored residential or other such ordinances or regulations which may be developed in the future.
FREESTANDING ATM: A self-service, interactive device that is located outside of and independent of the principal building or buildings, which is accessible to the general public for the purposes of dispensing money or information.
FRONTAGE: All property on one side of a street between two (2) intersecting streets (crossing or terminating), measured along the line of the street, or if the street is dead ended, then all of the property abutting on one side between an intersecting street and the dead end of the street. On a corner lot the frontage is the side with the lesser dimension.
GARAGE, PARKING: A structure, private or public, for the purpose of parking or storing automobiles. There shall be no dispensing of gasoline or oil and no repairs being made to the vehicles.
GARAGE, PRIVATE: An accessory building to a residence which houses motor driven vehicles. Such garage may house not more than one commercial vehicle of not more than one and one-half (11/2) tons' capacity and may not be used for the sale of motor fuel and/or oil or for the repair of motor vehicles.
GARAGE, SERVICE: A building used for housing, hiring, storing, equipping or repairing of motor driven vehicles.
GARDEN HOME: See definition of Row House, Townhouses.
GRADE:
A. For buildings having walls adjoining one street only, the established elevation of the highest point of the sidewalk along said one street. Where no sidewalk exists, the highest point of the curb shall be used.
B. For buildings having walls adjoining more than one street, the average of the highest point of the sidewalks along said streets. Where no sidewalk exists, the highest point of the curb shall be used.
GREEN STRIP: A street which is not currently required for vehicular traffic and is developed with lawn and trees as a green area and with a walkway for pedestrian traffic only. It remains public property and cannot be used for private purposes.
HEALTH CLUBS: A business establishment which offers physical fitness facilities such as swimming pools, workout rooms, handball or racquetball courts, running tracks or other such facilities. A massage service may be provided as necessary to the main function of physical fitness activities, provided it conforms to all requirements of village ordinances.
HEARING: Generally, an item or petition to be brought before the Zoning and Planning Commission or the Appeals and Review Board as a part of a regular agenda; not to be confused with a public hearing.
HOME OCCUPATIONS: The village is not opposed to the development of a business which starts as a small home occupation, providing that the home occupation does not impinge upon the rights and privileges of the abutting and adjoining homeowners and, further, that the home occupation is conducted in such a manner that it does not change in any way the neighborhood atmosphere of an R-1, R-2 or R-3 residential district. The following criteria shall be met by all home occupations:
A. Home occupations in all residential districts shall be considered as a revocable special use when such home occupation impinges upon the rights and privileges of the residential district in which it takes place.
B. A home occupation shall be any business or occupation carried on by a member of the immediate family residing within the dwelling unit.
C. The home occupation shall be incidental and secondary to the use of the dwelling unit for dwelling purposes and shall not occupy more than one-fourth (1/4) of the total area of any story, cellar, basement or accessory structure of the dwelling unit.
D. There shall be no signs, advertising, display or activity that will indicate from the exterior that the building is being used, in part, for any purpose other than that of a dwelling.
E. Media advertising shall be limited to name, occupational specialty, an office maildrop or post office box, telephone number and shall specify that personal contact is by appointment only. The address of the dwelling unit shall not be used in any advertising.
F. No commodities shall be sold on the premises except preordered merchandise. Such merchandise shall be limited to specialty goods and services only and shall not include general merchandise.
G. There shall be no commodity sold or services rendered that require receipt or delivery of merchandise, goods or equipment by other than a passenger motor vehicle, three-fourths (3/4) ton setup van, or by United States letter carrier mail service.
H. The home occupation shall be conducted by members of the immediate family only; except, that one additional employee may be utilized upon a conditional basis, i.e., accountant, secretary, draftsman, etc., but not on a full time basis.
I. All activities, including storage, shall be conducted completely within the dwelling unit or accessory structure and in no case shall there be visible outside storage of goods, supplies or equipment.
J. There shall be no perceptible noise, odor, smoke, electrical interference or vibration emanating from the structure in which the home occupation functions.
K. No mechanical or electrical equipment shall be used except such as is permissible for purely domestic or household purposes; except, that small business office equipment is permissible such as typewriters, calculators, etc.
L. A professional person may use his residence for consultations, emergency treatment or the performance of religious rites, but not for the general practice of his profession.
M. There shall be not more than one truck on the premises which shall not exceed a three-fourths (3/4) ton capacity, parked behind the building line, subject to chapter 13 of this title.
N. In no case shall appointments or other customer traffic be permitted which creates parking problems for the neighbors, nor shall home visitation be the principal source of customer business.
O. Catering and food manufacturing services are strictly prohibited as home occupations.
HOTEL: A building in which lodging is provided and offered to the public for compensation, and which is open to transient guests, in contradistinction to a boarding house or lodging house.
LAND COVERAGE: The land coverage ratio of the building or buildings on any lot is the floor area of the building or buildings and all accessory buildings on that lot divided by the area of such lot, or, in the case of planned developments, by the net site area after deducting street dedications.
LARGE COMMUNITY RESIDENCE: A community residence serving nine (9) to twenty (20) persons with disabilities.
LOADING BERTH: The ground area occupied or provided for a truck to unload at a deck or door.
LODGING HOUSE: A building or place where lodging is provided (or which is equipped regularly to provide lodging) by prearrangement for a definite period, for compensation, for three (3) or more, but not exceeding eight (8) individuals, not open to transient guests, in contradistinction to hotels open to transients, and not including convalescent, rest or nursing homes or community residences. The term “LODGING HOUSE” does not include short-term rentals.
LOT: A parcel of land occupied or intended for occupancy by a use permitted in this title, including one main building together with its accessory buildings, the open spaces and parking spaces required by this title, and having its principal frontage upon a street.
LOT, CORNER: A lot abutting upon two (2) or more rights of way at their intersection.
LOT, COVERAGE: The area of a lot occupied by the principal and accessory buildings.
LOT, DEPTH OF: The mean horizontal distance between the front and rear lot lines.
LOT, DOUBLE FRONTAGE: A lot having a frontage of two (2) nonintersecting streets, as distinguished from a corner lot.
LOT OF RECORD: A lot of record when referred to in this title shall mean and refer to a parcel of land which is a designated lot created and delineated in a duly recorded plat of subdivision.
MEDICAL CANNABIS CULTIVATION FACILITIES: A facility authorized by Illinois law and operated by an organization or business registered by the department of agriculture to perform necessary activities to provide only registered medical cannabis dispensing organizations with usable medical cannabis.
MEDICAL CANNABIS DISPENSING FACILITIES: A facility authorized by Illinois law and operated by an organization or business registered by the department of financial and professional regulation to acquire medical cannabis from a registered medical cannabis cultivation facility for the purpose of dispensing cannabis, paraphernalia, or related supplies and education materials to registered qualifying patients.
MEDICAL OFFICE/CLINIC: A premises or part thereof where patients, who are not lodged overnight, except for observation or emergency treatment, are treated by one person or group of persons practicing any form of healing or health building services to individuals, whether the practitioners are physicians (i.e., medical doctors), chiropractors, osteopaths, chiropodists, podiatrists, naturopaths, dentists, psychologists and counselors of all types, psychiatrists, nurse practitioners, optometrists, physical therapists, or any such profession, the practice of which is regulated by Illinois law. Ancillary uses, such as pharmacies, eyewear centers, and the like may be located on the premises.
MOBILE HOME: Any vehicle, house car, camp car or any portable or mobile vehicle on wheels, skids, rollers or blocks, either self-propelled or propelled by any other means, which is used, or designed to be used, permanently or temporarily, exclusively for residential occupancy.
MOBILE HOME PARK: Any area or premises on which are parked two (2) or more mobile homes or trailers or any premises on which space for parking of mobile homes or trailers is rented, or held out for rent, or on which free occupancy or camping is permitted to the owners or users of mobile homes or trailers for the purpose of securing their trade. The term "mobile home park" does not include sales lots on which unoccupied mobile homes or trailers, whether new or used, are parked for the purpose of inspection and sale.
MOTEL: A building designed or intended to provide temporary sleeping accommodations for automobile transients and having off street parking spaces in the immediate vicinity of the building and not including facilities for the storage, preparation or cooking of food.
NONCONFORMING USE: Any building or land lawfully occupied by a use at the time of passage of the original zoning ordinance or any amendment thereto, which does not conform after the passage of the zoning ordinance or amendment thereto with the use regulations of the district in which it is situated.
NURSING HOME: A licensed public or private home or institute which provides maintenance, personal care, and nursing for three (3) or more persons who by reason of physical illness or infirmity are incapable of maintaining a private, independent residence.
OFFICE OF QUALITY CONTROL: Department comprised of the bureaus of engineering and traffic, building code enforcement, planning and zoning, health and sanitation, and fire prevention. Administrative officers in this department include the director of office of quality control, administrator of planning, building and zoning, health/sanitation officer, and chief fire inspector.
PARKING SPACE: A durable surface area, in conformance with the requirements of section 4-13-3-2 of this title, enclosed in the main building, in an accessory building, or unenclosed, sufficient in size to store one standard automobile, and comprising an area of not less than one hundred eighty (180) square feet, with dimensions of not less than nine feet by twenty feet (9' x 20'), exclusive of a durably surfaced driveway connecting the parking space with a street or alley and permitting satisfactory ingress and egress of an automobile. However, for purposes of calculating the required square footage of parking area under this title, a figure of two hundred eighty eight (288) square feet per parking space shall be used so as to take into consideration the necessity of a driveway to service the parking space.
PAYDAY LOAN: A loan transaction in which a postdated check, or other check that the parties agree will be held for a period of time prior to presentment for payment or deposit, is accepted as collateral for the loan.
PAYDAY LOAN STORE: A commercial establishment which engages in the business of offering payday loans.
PERSON WITH A DISABILITY: Any individual whose disability:
A. Is attributable to mental, intellectual or physical impairments or a combination of mental, intellectual or physical impairments; and
B. Is likely to continue for a significant amount of time or indefinitely; and
C. Results in functional limitations in three (3) or more of the following areas of major life activities:
1. Self-care;
2. Receptive or expressive language;
3. Learning;
4. Mobility;
5. Self-direction;
6. Capacity for independent living;
7. Economic self-sufficiency; and
D. Reflects the person's need for a combination and sequence of special interdisciplinary or generic care, treatment or other services which are of a lifelong or extended duration.
PLANNED DEVELOPMENT (OR PLANNED UNIT DEVELOPMENT): A zoning classification in which several types of residence uses, such as single-family and multi-family, may be combined and in which other uses, such as commercial, may be considered, all under a comprehensive plan subject to the approval of the Zoning and Planning Commission and the board of trustees.
PRECIOUS METALS DEALERS: An establishment primarily engaged in the business of purchasing precious metals including, but not limited to, gold, silver, platinum, stones, or gems in any form from the public. A business primarily engages in the purchasing of precious metals from the public if twenty percent (20%) or more of the businesses' total revenue during any month is procured from the purchasing of precious metals. This definition specifically excludes purchases by a dealer from a reputable wholesale supplier or other licensed dealer of such elements or objects for resale to the public at retail.
PUBLIC HEARING: A hearing which complies with the formal requirements of section 2-1-8-1 of this code.
RESTAURANT, BANQUET HALL: Petition required twenty five dollars ($25.00). A food service establishment, other than a full service restaurant, which caters to groups of people who are there for a specific purpose or event which may or may not include the consumption of food. Permitted in C-1, C-2, C-3 or M-1 zoning districts.
RESTAURANT, CAFETERIA: Petition required twenty five dollars ($25.00). A food service establishment where the food is served from various types of containers while the customer passes along a line of such foods which are on display for his choice. The customer enters the building, picks up a tray, follows the line, makes his food selection, carries the tray to a table and then consumes the food. All food is consumed solely on the premises. Permitted in C-3 zoning district only.
RESTAURANT, CARRYOUT: Petition required twenty five dollars ($25.00). A food service establishment without interior or exterior facilities for eating, where the customer either preorders his selection or places an order in person. The food is packaged and the customer carries out the food off of the premises of the establishment for consumption elsewhere, usually, but not always, in his own home. A drive-through only restaurant facility shall be considered a carryout restaurant; however, if used in combination with any other type restaurant facility, the mixed use restaurant provisions shall apply. Permitted in C-1, C-2, C-3 or M-1 zoning districts.
RESTAURANT, FAST FOOD: Petition required twenty five dollars ($25.00). A food service establishment where the customer enters the establishment, places an order, receives his order either on a tray (other than a cafeteria) or in some form of package, and then either consumes the food in the building where such food is prepared or elsewhere, on or off the premises, excepting therefrom the carryout food type establishment where no food is consumed either inside or outside the premises where the food was prepared. Permitted in C-3 zoning district only.
RESTAURANT, FULL SERVICE: Petition required twenty five dollars ($25.00). Where the customer is seated, a waiter or waitress takes the customer's order, brings food and after the customer has consumed same, brings a bill for the food and clears the table in preparation for the next customer. All food is consumed inside of the establishment. Permitted in C-1, C-2, C-3 or M-1 zoning districts.
RESTAURANT, MIXED USE: Petition required twenty five dollars ($25.00). A food service establishment which combines two (2) or more of the restaurant uses as defined above. For the purpose of establishing a proper zoning category the following criteria shall be used:
A. Any fast food or cafeteria use in conjunction with any other restaurant use shall place the entire facility into a C-3 zoning classification.
B. A food service establishment which combines a full service restaurant, banquet hall and/or a carryout restaurant may be placed into any commercial or manufacturing zone.
RETAIL JEWELRY STORE: An establishment primarily engaged in the retail sale of jewelry or other items made of precious metals, stones, or gems to the public and may include repair, cleaning, and incidental fabrication but may not include casting of metals. A business primarily engages in the retail sale of jewelry or other items made of precious metals, stones, or gems to the public if eighty percent (80%) or more of its total revenue is procured from the retail sale of jewelry or other items made of precious metals, stones or gems.
ROOMING HOUSE: See definition of Lodging House. The term “ROOMING HOUSE” does not include short-term rentals.
ROW HOUSE, TOWNHOUSES: A group of single-family dwellings having a common wall, without openings, between two (2) units. For the purpose of this title, they shall be considered as a "dwelling, multiple".
SATELLITE DISH ANTENNA: Any dish type satellite signal receiving station or disc antenna with an essentially solid surface, whether flat, concave, or parabolic which is designed for receiving television, radio, or data microwave signals from satellites or other sources, or for transmitting such signals to a receiving station.
SHELTER, FALLOUT: A structure or portion of a structure intended to provide protection to human life during periods of danger to human life from nuclear fallout, air raids, storms or other emergencies, and shall be considered as an accessory use, if not as an integral part, of the principal structure on a lot.
SHORT-TERM RENTAL: A single room or a portion thereof in single-family dwelling, a partial or entire single-family dwelling, or a dwelling unit in a multi-unit structure, condominium, cooperative, timeshare, or similar joint tenancy property ownership arrangement, that is offered for rent for a period shorter than thirty (30) consecutive days to any person other than a member of the owner's family. The term "short-term rental" shall not include hotels, rooming house, motels, or lodging establishments lawfully established and licensed pursuant to the Zoning Ordinance and the Village Code, or a unit that is used for non-residential purposes such as educational, healthcare, retail, restaurant, banquet space, event center, or other similar uses, and "short-term rental" shall also not include dwelling units owned by the federal government, the State, or any of their agencies or political subdivisions and facilities licensed by the State as health care facilities.
SMALL COMMUNITY RESIDENCE: A community residence serving eight (8) or fewer persons with disabilities in a family like atmosphere.
SPECIAL DISTRICT: A geographic area with clearly defined boundaries created by the village for the purpose of developing or redeveloping said area within special regulations promulgated by the village.
STORY: That portion of a building other than a basement, included between the surface of any floor and the surface of the floor next above it, or, if there be no floor above it, then the space between the floor and the ceiling next above it, including a story which has more than one-half (1/2) of its height above grade.
STORY, HALF: A space under a sloping roof having an average clear height of seven feet six inches (7'6") over not more than sixty percent (60%) of the floor area.
STREET: All property dedicated or intended for public or private street, highway, freeway or roadway purposes or subject to easements therefor.
STREET LINE: A dividing line between a lot, parcel or tract of land and a contiguous street.
STRUCTURAL ALTERATIONS: Any change in the supporting members of a building, such as bearing walls or partitions, columns, beams or girders, or any substantial change in the roof or in the exterior walls.
STRUCTURE: Anything constructed or erected, the use of which requires permanent or temporary location on or in the ground or attached to something having a permanent or temporary location on or in the ground, including, but without limiting, the generality of the foregoing; building, advertising signs, backstops for tennis courts, billboards, pergolas and swimming pools; provided however, that this definition shall not include underground tanks for the storage of any type of fuel.
SWIMMING POOL: Any temporary or permanent artificial pool or receptacle for water installed, constructed or maintained in, on or above the ground (not including those enclosed and located entirely within a dwelling), having a perimeter of more than twenty five feet (25') and/or a depth of more than two feet (2') at any point. A swimming pool shall be considered to be a main building and use; provided, however, that a permanent, inground swimming pool may be considered to be an accessory building or use customarily incident to a dwelling when located on the same lot therewith and designed and used for swimming pool or bathing in connection with such dwelling solely by the persons living therein or their private guests. No swimming pool designed or used for any commercial or other nonresidential purpose shall be considered to be an accessory building or use customarily incident to a dwelling.
TRAILER: See definition of Mobile Home.
TRANSPORTATION SHELTERS: Privately owned, permanent structures on or adjoining principal rights of way on arterial streets, erected for the purpose of providing shelter from the weather for public mass transportation passengers and containing up to six (6) panels of backlighted advertising.
USE, CHANGE OF: An alteration by change of use in a building heretofore existing to a new use group which imposes other special provisions of law governing building and zoning.
WING WALL: A short section of wall used in building construction as an ornamental extension of the exterior wall of a building.
YARD: An open space on the same lot with a building, unoccupied and unobstructed by any portion of a structure from the ground upward, except as otherwise provided herein. In measuring a yard for the purpose of determining the width of a side yard, the depth of the front yard, or the depth of a rear yard, the minimum horizontal distance between the lot line and the nearest vertical projection of a structure shall be used.
YARD, FRONT: A yard extending across the front of a lot between the side lot lines, and being the minimum horizontal distance between the street line and the main building or any projection thereof other than the projection of the usual steps.
YARD, REAR: A yard extending across the rear of a lot, between the side lot lines, and being the minimum horizontal distance between the rear lot line and the rear of the main building or any projections other than steps. On corner lots, the rear yard shall be considered as parallel to the street upon which the lot has its least dimension. On both corner lots and interior lots, the rear yard shall in all cases be at the opposite end of the lot from the front yard.
YARD, SIDE: A yard between the main building and the side lot line, extending from the front yard line to the rear yard line.
