3-4H-3: SCHEDULING, COMMUNITY EVENTS CALENDAR 1 ; FEES:
   A.   The fees required to be paid to the village by a carnival operator shall be waived by the village if the sponsor is a resident nonprofit organization. However, the deposit required under section 3-4A-1-3 of this chapter shall be paid. No more than two (2) carnivals may be sponsored by one nonprofit organization in any calendar year.
   B.   No carnival shall be scheduled on the community events calendar, as established in section 3-1-7-4 of this title, to commence less than ten (10) days after the scheduled completion of the most recent one; provided, however, that the village board may allow a carnival to commence less than ten (10) days after the scheduled completion of, or at the same time as, another carnival; provided that a finding is made as to each of the following conditions:
      1.   That the location of the second carnival will not be so close to the first carnival that traffic congestion will result; and
      2.   That the scheduling of the second carnival, less than ten (10) days after the scheduled completion of, or at the same time as, the first carnival will not unduly burden the village's police department in carrying out its duties throughout the village and, specifically, in maintaining order at both carnivals; and
      3.   That strict adherence to the ten (10) day requirement would cause particular hardship to the second carnival license applicant.
   C.   When a carnival is sponsored by a nonprofit organization, the operator shall guarantee the sponsoring organization a minimum payment of one thousand five hundred dollars ($1,500.00). (Ords. 76-10-21, 87-21-89)
