§135.36 RESTORE ILLINOIS PLAN; PHASE 4 TIERED MITIGATIONS.
   (A)   During any period that the city is subject to Phase 4 of the Restore Illinois Plan and Tier 1 of the public health restrictions and mitigations as determined by the Governor of the State of Illinois, it shall be unlawful for a business establishment in the city, including, but not limited to, a bar or restaurant, that serves food or beverages for on-site consumption to fail to comply with all of the following:
      (1)   All restaurants and bars in the city must close at 11:00 p.m., and must remain closed until 6:00 a.m. the following day;
      (2)   All restaurants and bars in the city shall limit indoor on-premises consumption of food or beverages to the lesser of 25 guests or 25% capacity per room;
      (3)   All establishments offering indoor on-premises consumption of beverages shall serve food;
      (4)   Indoor service reservations shall be limited to a two-hour maximum duration and a maximum of four persons per table;
      (5)   All customers eating or drinking on premises outdoors shall be seated at tables spaced at least six feet apart;
      (6)   Multiple parties of customers shall not be seated at a single table;
      (7)   Customers who are not yet seated at a table shall wait off premises;
      (8)   Customers, when waiting, shall not stand or congregate in groups larger than the party with whom they are dining; and
      (9)   Each party shall have a reservation, even if made on-site, so that the restaurant or bar has contact information to reach every party for contact tracing if needed.
   (B)   During any period that the city is subject to Phase 4 of the Restore Illinois Plan and Tier 1 of the public health restrictions and mitigations as determined by the Governor of the State of Illinois, it shall be unlawful for a business establishment in the city holding a meeting or social event to fail to comply with all of the following:
      (1)   Meetings and social events shall be limited to the lesser of 25 people or 25% of overall room capacity;
      (2)   Attendance lists shall be kept for contact tracing; and
      (3)   Party buses are prohibited.
   (C)   During any period that the city is subject to Phase 4 of the Restore Illinois Plan and Tier 1 of the public health restrictions and mitigations as determined by the Governor of the State of Illinois, it shall be unlawful for a gaming business establishment in the city to comply with all of the following:
      (1)   Gaming venues shall close and gaming terminals shall stop operating, between 11:00 p.m. and 6:00 a.m. the following day;
      (2)   Gaming venues shall be limited to 25% capacity; and
      (3)   Gaming venues must follow the mitigation measures for restaurants and bars for those portions of their facilities.
   (D)   During any period that the city is subject to Phase 4 of the Restore Illinois Plan and Tier 2 or 3 of the public health restrictions and mitigations as determined by the Governor of the State of Illinois, it shall be unlawful for a business establishment in the city, including, but not limited to, a bar or restaurant, that serves food or beverages for on-site consumption to fail to comply with all of the following:
      (1)   All restaurants and bars in the city must close at 11:00 p.m., and must remain closed until 6:00 a.m. the following day;
      (2)   All restaurants and bars in the city shall suspend indoor on-premises consumption of food or beverages;
      (3)   All establishments offering indoor on-premises consumption of beverages shall serve food;
      (4)   All customers eating or drinking on premises outdoors shall be seated at tables spaced at least six feet apart;
      (5)   Multiple parties of customers shall not be seated at a single table;
      (6)   Tables shall be limited to groups of six or fewer;
      (7)   Customers who are not yet seated at a table shall wait off premises;
      (8)   Customers, when waiting, shall not stand or congregate in groups larger than the party with whom they are dining; and
      (9)   Each party shall have a reservation, even if made on-site, so that the restaurant or bar has contact information to reach every party for contact tracing if needed.
   (E)   During any period that the city is subject to Phase 4 of the Restore Illinois Plan and Tier 2 of the public health restrictions and mitigations as determined by the Governor of the State of Illinois, it shall be unlawful for a business establishment in the city holding a meeting or social event to fail to comply with all of the following:
      (1)   Meetings and social events shall be limited to ten people or fewer;
      (2)   Attendance lists shall be kept for contact tracing; and
      (3)   Party buses are prohibited.
   (F)   During any period that the city is subject to Phase 4 of the Restore Illinois Plan and Tier 2 of the public health restrictions and mitigations as determined by the Governor of the State of Illinois, it shall be unlawful for a gaming business establishment in the city to comply with all of the following:
      (1)   Gaming venues shall close and gaming terminals shall stop operating, between 11:00 p.m. and 6:00 a.m. the following day;
      (2)   Gaming venues shall be limited to 25% capacity; and
      (3)   Gaming venues must follow the mitigation measures for restaurants and bars for those portions of their facilities.
   (G)   During any period that the city is subject to Phase 4 of the Restore Illinois Plan and Tier 3 of the public health restrictions and mitigations as determined by the Governor of the State of Illinois, it shall be unlawful for a business establishment to hold a meeting or social event of any size in the city.
   (H)   During any period that the city is subject to Phase 4 of the Restore Illinois Plan and Tier 3 of the public health restrictions and mitigations as determined by the Governor of the State of Illinois, it shall be unlawful for a gaming business establishment to operate in the city.
