§135.35 SOCIAL DISTANCING.
   (A)   The owner or operator of a bar, restaurant or public indoor place shall promulgate, publish on the premises of the business and enforce rules consistent with this subchapter requiring social distancing, hand washing, and other protective measures for customers and employees based upon guidelines provided by the Centers of Disease Control and the Illinois Department of Public Health, and where applicable, the United States Occupational Safety and Health Administration (OSHA).
   (B)   Businesses shall take proactive measures to ensure compliance with social distancing, including where possible:
      (1)   Designate six-foot distances. Designating with signage, tape, or by other means six-foot spacing for employees and customers to maintain appropriate distance;
      (2)   Hand sanitizer and sanitizing products. Having hand sanitizer and sanitizing products readily available for employees and customers;
      (3)   Separate operating hours for vulnerable populations. Implementing separate operating hours for elderly and vulnerable customers;
      (4)   Online and remote access. Posting online whether a facility is open and how best to reach the facility and continue services by phone or remotely; and
      (5)   Face coverings and personal protective equipment. Providing employees with appropriate face coverings and requiring that employees wear face coverings where maintaining a six-foot social distance is not possible at all times. When the work circumstances require, providing employees with other personal protective equipment in addition to face coverings.
   (C)   During any period that the city is subject to Phase 4 of the Restore Illinois Plan and Tier 1 or 2 public health restrictions and mitigations, as determined by the Governor of the State of Illinois, it shall be unlawful for a business establishment, including, but not limited to, a bar or restaurant, that serves food or beverages for on-site consumption to fail to comply with all of the following:
      (1)   Social distancing shall be maintained at all times;
      (2)   Tables shall be spaced such that no person and their companions seated at a table are less than six feet from another seat or person and their companions at a different table;
      (3)   Persons seated at a bar must be spaced such that no person with their companions seated at the bar is less than six feet from another person or their companions;
      (4)   Bars shall not maintain spaces that allow the congregation of unseated people; and
      (5)   Bar patrons shall not be permitted to remain unseated at a table or at the bar, in any area of the bar, unless waiting to be seated.
