No person shall open, uncover, or in any manner make connection with any municipal water main or line nor lay any water line on any premises or in any street, alley, or right-of-way in the city until such person has obtained a permit from the city.
(A) The application for a water system connection permit shall be in the form of a water service agreement, which shall be provided by the city together with the permitting requirements contained in § 95.33.
(B) The city shall attach to every water system connection permit such conditions as may be necessary to ensure compliance with all applicable provisions of this code, the State Plumbing Code, the ordinances of DuPage County, and the regulations of the DuPage County Department of Public Health.
(C) (1) As part of the permit issuance, the permittee shall pay any and all fees required by § 52.08 and, further, shall post security as is required by § 95.50 for the work to be performed.
(2) The security which is required to be provided for water service line installation by § 95.50 shall be posted to assure proper installation and connection to the city's water supply system and to assure the proper restoration of the public street and/or right-of-way, as is appropriate.
(3) So long as the permittee connects to the city's water supply system in such a manner that the city's water supply system is not damaged or in need of repair, and further, that the restoration of either the public street and/or the right-of-way are satisfactorily completed and approved, then the security shall be refunded pursuant to the provisions of § 95.50.
(4) In the event that restoration is not made and approved by the city, or the permittee causes the city's water system to be damaged or need repair, all or a portion of the security deposit shall be withdrawn by the city according to the provisions of § 95.50. In addition to the withdrawal of some or all of the permittee's security deposit, any permittee failing to restore the public street or right-of-way to the satisfaction of the Public Services Director shall be deemed guilty of a violation of § 95.39.
(5) All materials removed from the public streets or rights-of-way in making excavations for water taps shall be deposited in such a manner that such materials will cause the least inconvenience to the public and will not interfere with stormwater runoff, and in a manner consistent with the requirements of § 95.44.
(E) Unless recommended by the Public Services Director and approved by the City Administrator, no person shall be permitted to make any connection of any water service to any part of the municipal water system, including any water pipe, hydrant, structure or appurtenance thereto, from November 1 through March 1, or at any other time of any year if, in the opinion of the Public Services Director, conditions would otherwise place the water supply or its users at risk.
