8-3-4: CONNECTION REQUIRED:
   A.   Requirement; Time Limit: It is hereby declared to be the duty of the owner of all houses, buildings, or properties used for human occupancy, employment, recreation or other purposes, situated within the city service area and abutting on any street, alley or right of way in which there is now located or may be in the future located a public sanitary sewer of the city, at his or her expense, to connect such facilities directly with the public sewer, either by gravity or with approved pumping facilities, in accordance with the provisions of this chapter, within one hundred eighty (180) days after the date of official notice to do so; provided, that said public sewer is available to or on the property and/or at a property line of said property, and the facilities are within three hundred feet (300') of the public sewer.
   B.   Filing Objections With Council: In the event that, during the said period of one hundred eighty (180) days, the said owner shall file his or her written objections with the city recorder against so being required to make said connection, the city shall not enforce the provisions of this section upon said owner so filing his or her objections until the city council shall have, at a meeting thereof, heard the objections of said owner, and rendered its decision thereon. The meeting of the council shall be held not less than ten (10) days nor more than thirty (30) days from and after the date of the filing of said objections with the city recorder. Not less than seven (7) days prior to the date set by the council for said meeting, the city shall give due notice of the date set therefor to said owner. The decision of the council shall be final and no appeal shall be taken therefrom by said owner, except as is provided by law.
   C.   Failure To Connect Or Pay Sewer Charges: Any owner who shall fail, refuse or neglect to make connection to the sewer system within one hundred eighty (180) days after written notice to make such connection shall be deemed guilty of a misdemeanor. Failure to pay sewer charges may result in termination of water service pursuant to section 8-3-25 of this chapter. (Ord. 624-08, 8-12-2008)
