8-3-25: VIOLATION; PENALTY:
   A.   Notice To Cease Violation: Any person found to be violating any provision of this chapter shall be served by the city with written notice stating the nature of the violation and providing a reasonable time limit for the satisfactory correction thereof. The offender shall, within the period of time stated in such notice, permanently cease all violations.
      1.   Failure to cease violation may result in termination of water services.
      2.   Violators shall be charged actual expenses incurred by city for cleaning of lines to remove chemicals or other blockage and other expenses incurred by public works crew.
   B.   Continuing Violation; Penalty Imposed: Any person who shall continue any violation beyond the time limit provided for in subsection A of this section shall be guilty of a misdemeanor and, on conviction thereof, shall be fined in the amount of one thousand dollars ($1,000.00) per violation. Each day in which any such violation shall continue shall be deemed a separate offense.

   C.   Repeat Violations:
      1.   Any person who has repeat violations or fails to repair violation thereof may experience termination of water services, until violation is corrected.
      2.   Repeat violators will be required to submit copies of cleaning records to city hall every sixty (60) days to be inspected after noted violation.
   D.   Penalty For Noncompliance: The violation of the provisions of this chapter, or the failure to conform to its conditions, shall subject the person of such violation or failure, on conviction, to a fine of one thousand dollars ($1,000.00) per violation. Each day in which any such violation or failure shall continue shall be deemed a separate offense.
   E.   Liability: Any person violating any of the provisions of this chapter shall become liable to the city for any expense, loss or damage occasioned by the city by reason of such violation. (Ord. 624-08, 8-12-2008)
