(a) New Buildings. A building or structure hereafter erected shall not be used, occupied or rented in whole or in part until a certificate of use and occupancy for each unit has been issued by the Building Commissioner.
(b) Buildings Hereafter Altered. A building or structure hereafter enlarged, extended or altered, in whole or in part, shall not be used, occupied or rented until a certificate of use and occupancy has been issued; except that any use or occupancy for which a certificate had previously been issued, which was not discontinued during the work of alteration shall require the issuance of a certificate by the Building Commissioner within thirty days after completion of the work of alteration.
(c) Changes in Use. A building or structure hereafter changed, in whole or in part, from one use group to another, or to a different use within the same use group, shall not be occupied or rented for the new use until:
(1) The building conforms to the applicable provisions of the Norwood Building Code (NBC) for the new use; and
(2) A Certificate of Use and Occupancy has been issued by the Building Commissioner for each unit of such changed portions.
(d) Ongoing Inspections. The Building Commissioner shall make or cause to be made an inspection of any building or equipment installation or property that may become dangerous, unsanitary or unsafe, and for compliance with provisions of the NBC.
(e) Temporary Occupancy. Upon the request of the holder of a building permit, the Building Commissioner may issue a Temporary Certificate of Use and Occupancy, before the entire work covered by the permit has been completed, for those units of a building or structure without endangering life or public welfare.
(f) Fee. The fee for a Certificate of Use and Occupancy required by the NBC shall be as prescribed in Section 1305.05(j) and shall be paid at the time the permit is issued or the inspection is performed. The fee for a Rental Certificate required by the NBC shall be as prescribed in Section 1305.05(j) and shall be paid prior to the first inspection for each new or renewed Rental Certificate. The fee for Temporary Certificates of Use and Occupancy shall be as prescribed in Section 1305.05(j) and paid at the time of issuance and prior to any re-inspection.
(g) Revocation of Certificates. The Code Official may revoke the Certificate of Use and Occupancy issued under the provisions of the NBC and/or may order vacation of the occupancy for any of the following reasons:
(1) Whenever there is a violation of any provisions of the Norwood Building Code or any ordinance relating to the same subject matter.
(2) Whenever there is a violation of any condition on which the issuance of the certificate was based.
(3) Whenever the continuance of any work becomes dangerous to life or property.
(4) Whenever any false statement, information or misrepresentation has been made in relation to the issuance of the certificate.
(5) The revocation notice of the certificate in every instance shall be in writing and shall be served upon the holder of the certificate, the owner, their agent, or the person having charge of the work. Any revocation notice shall also be posted upon the building or structure in question by the Code Official. After the notice is received or posted, no person shall proceed with any operation for which such a certificate was issued. The revocation of a certificate shall be subject to an appeal as provided in Section 1305.17.
