917.18 DISCOVERY OF UNLAWFUL USES.
   (a)   Whenever the existence of an unlawful street use in violation of this Chapter herein shall be brought to the attention of the City, the Service Director shall order such use to be discontinued within 30 days, unless during such period proper application shall be made in accordance with the provisions of this chapter for a special street privilege and the sum of one hundred dollars ($100.00) shall be paid to the City Treasurer as compensation for the previous unlawful use; provided that, if the City shall be of the opinion that the value of the use to the person, firm or corporation unlawfully making such private use is greater than one hundred dollars ($100.00) over the period in which the use has existed, or during the period of the preceding five years if the length of the period cannot be determined, the application shall be required to pay a sum in addition to the one hundred dollars ($100.00) payment sufficient to pay the reasonable value of the secret use.
   (b)   Nothing in this section shall be construed to relieve any person from prosecution or penalty in accordance with the provisions of this Chapter.
