375.10 SNOWMOBILE OPERATION ON PRIVATE PROPERTY.
   (a)   No snowmobile shall be operated on any private property within the City unless all of the following conditions and limitations are complied with:
      (1)   The owner or person having the right to possession of the private property involved has granted permission to operate the snowmobile.
      (2)   The snowmobile is not operated:
         A.   Within ten feet of adjoining property;
         B.   Within fifty feet of the nearest portion of any public sidewalk or public street, unless otherwise provided in this Traffic Code;
         C.   In any front yard;
         D.   Within 150 feet of any dwelling or business establishment except a dwelling or business establishment owned or controlled by the property owner mentioned in subsection (a) hereof; and
         E.   In violation of Section 337.30(c).
      (3)   The snowmobile is not operated between the hours of 9:00 p.m. and 9:00 a.m. (Ord. 94-110. Passed 10-18-94.)
   (b)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
