375.08 ALL PURPOSE VEHICLE, OPERATION ON PRIVATE PROPERTY.

   No all purpose vehicle shall be operated on any private property within the City unless all of the following conditions and limitations are complied with:

   (a)   The owner or person having the right to possession of the private property involved has granted permission to operate the all purpose vehicle.

   (b)   The all purpose vehicle is not operated:

      (1)   Within ten feet of adjoining property;

      (2)   Within fifty feet of the nearest portion of any public sidewalk or public street;

      (3)   In any front yard;

      (4)   Within 300 feet of any dwelling or business establishment except a dwelling or business establishment owned or controlled by the property owner mentioned in subsection (a) hereof; and

      (5)   Outside of the noise levels provided within Section 337.30(a) or (b).

   (c)   The all purpose vehicle is not operated between the hours of 6:00 p.m. and 10:00 a.m.

   (d)   No owner of private property shall recklessly permit an individual to violate this section. (Ord. 94-102. Passed 9-20-94.)

   (e)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
