1309.99 PENALTY.

   (a)   Except as provided in subsection (b) hereof, no person, being the owner or having the control as an officer, or as a member of a board or committee or otherwise, of any building or structure or part thereof, shall knowingly violate or shall permit or assist in the violation of any of the provisions of this chapter and any person who may be employed or assist in the commission of any such violation, and any person who shall violate or fail to comply with any order or regulation made by proper authority, or who shall build in violation of any detailed specifications or plans submitted or approved thereunder, or of any certificate or permit issued thereunder, shall be guilty of a misdemeanor of the third degree for a first offense and a misdemeanor of the first degree for each subsequent offense.

   (b)   Whoever violates Section 1309.08(c) shall be guilty of a minor misdemeanor. Any such violation shall constitute a separate offense on each successive day continued.
