1309.08 REQUIREMENTS FOR NEW BUILDINGS.
No new buildings shall be constructed unless the following conditions are complied with:
(a) Provisions must be made for the adequate drainage of all storm and roof water into a storm sewer or into a natural drainage if no storm water sewers are available. The owner of any real property upon which the owner intends to improve by construction, erecting or placing a residence, accessory building or garage shall:
(1) Prepare and present to the City Engineer or Building Official a site plan for the City’s review and approval prior to constructing, erecting or placing such structure upon their real estate, indicating the following:
A. Property lines and dimensions.
B. Location of proposed building(s) including building setback distances.
C. Elevations at lot corners.
D. Elevations at proposed building corners.
E. Proposed design for collection/dispersion of storm water.
(2) Grade their real estate so that no additional storm water shall be diverted to neighboring real estate.
(b) Provisions must be made for drainage of all sanitary sewage into sanitary sewers. Drainage of sanitary sewage into storm sewers will not be permitted, except into such combination sanitary and storm water sewers which may exist in some parts of the City. No person shall permit storm water to be drained into a combination sewer.
(c) Sidewalks shall be constructed in accordance with Section 905.05.
(d) No occupancy permit shall be issued unless all the conditions herein required have been complied with.
(e) Property owners who create drainage problems by grading their lots towards adjoining property owners should be held responsible to correct any resulting problems whether there are storm sewers available or not.
(f) Any person or firm violating or not conforming to the provisions of this section shall be subject to the penalty provided in Section 1309.99.
