The applicable ordinances and extent of the duties of the Codes Enforcement Officer are as follows.
(A) Chapter 50, “Solid Waste”, “Storage and Collection”, §§ 50.01 through 50.07 and 50.99: the Codes Enforcement Officer shall have the duty and the authority to inspect for violations of the provisions of the aforesaid § 50.01 through 50.07 and 50.99 of this code, and to bring prosecutions in the name of the borough before a magisterial district judge either on personal knowledge or on information had and received.
(B) Chapter 72, §§ 72.01 through 72.05, “Parking Regulations” and Chapter 76, Schedules I through VIII, “Parking Schedules”: in addition to the police officers of the borough, the Codes Enforcement Officer is designated as a “Parking Enforcement Officer of the borough” with all of the duties and authority set forth for “parking enforcement personnel” in §§ 72.01 through 72.05. In case of a failure of a violator to pay the fine set forth in § 72.02 within the time limit of 48 hours, the Codes Enforcement Officer has the authority to bring a prosecution in the name of the borough before a magisterial district judge either on personal knowledge or on information had and received.
(C) (1) Chapter 90 of the code of ordinances of the borough (Ord. 88-1):
(2) In addition to police officers of the borough, the Codes Enforcement Officer is hereby designated a dog warden within the meaning of § 90.03 of this code of ordinances, with all the duties and authority set forth therein. Said designated duties and authority shall be applicable to §§ 90.01 through 90.06, 90.20 through 90.22 and 90.35 through 90.37.
(D) Chapter 92, Health and Safety, “Vegetative Nuisances”, §§ 92.001 through 92.003, “Motor Vehicle Nuisances”, §§ 92.015 through 92.021.
(1) The Codes Enforcement Officer is designated as an officer or employee of the borough who is charged with the enforcement of §§ 92.001 through 92.003, “Vegetation Nuisances”, including the giving of notice as required by § 92.003 thereof, informing the borough of the failure of the owner to comply with said notice, and bringing prosecutions in the name of the borough before a magisterial district judge on the basis of personal knowledge or on the basis of information had and received.
(2) With respect to §§ 92.015 through 92.021, “Motor Vehicle Nuisances”, the Codes Enforcement Officer, pursuant to Ord. 88-1, is designated as an Enforcement Officer pursuant to § 92.018 with all of the duties and authority set forth therein with respect to the enforcement of §§ 92.015 through 92.021. In addition, he or she may bring prosecutions in the name of the borough before a magisterial district judge either on personal knowledge or information had and received.
(E) Chapter 94, “Sidewalk Hazards/Obstructions”, §§ 94.060 through 94.062 and 94.075 and 94.076: the Codes Enforcement Officer shall have the duty and authority to inspect for violations of the provisions of the aforesaid §§ 94.060 through 94.062 and 94.075 and 94.076, to send whatever notices are therein provided for and to bring prosecution in the name of the borough before a magisterial district judge for such violation either on personal knowledge or information had and received.
(F) Chapter 130 “Curfew”, §§ 130.01 through 130.08 and 130.99: the Codes Enforcement Officer is authorized to bring prosecutions in the name of the borough for violations of this chapter of this code before a magisterial district judge either on the basis of personal knowledge or on the basis of information had and received pursuant to § 130.04 of this code as appropriate.
