(a) No person shall, without privilege or authority to do so, knowingly move, remove, scavenge or otherwise improperly tamper with the property of another person, said property consisting of items of refuse, trash, garbage or rubbish, which items have been placed at the curbside or otherwise set aside for collection for recycling purposes. These items shall include, but are not limited to, aluminum cans, glass bottles and jars, newspapers, plastic containers, cardboard and all other items which may become part of an organized recycling campaign by the City or by an authorized collection agent or agency.
(b) Whoever violates this section is guilty of a misdemeanor of the fourth degree and shall be subject to the penalty provided in Section 698.02.
