(a) In such areas within or immediately surrounding retail establishments within the City which are designated by the proprietor or manager thereof, as areas wherein smoking shall be prohibited, no person shall light and smoke tobacco in any form. Such prohibition shall be effective only with respect to such areas which, because of congestion of persons or the inflammatory nature of building fixtures, structures or goods displayed for sale, involve an unreasonable fire hazard, and then only upon condition that appropriate placards or signs are posted which reasonably advise and warn persons of such prohibition.

(b) Whoever violates this section is guilty of a minor misdemeanor and shall be subject to the penalty provided in Section 698.02.
