660.13 FENCES.
   (a)   No person shall construct or maintain along or in close proximity to property boundary lines which abut upon a public street, sidewalk or pathway customarily used by pedestrians, a fence in excess of forty-eight inches in height or constructed with or utilizing barbed wire or any other type of material or construction involving the exposure along the side or the top thereof of wire or metal prongs or sharp edges of such nature as to inflict personal injury upon contact therewith.

   (b)   The owner, tenant, lessee or person in charge of property upon which a fence is constructed or maintained in violation of this section is guilty of a minor misdemeanor. A separate offense shall be deemed committed each day during or on which a violation occurs or continues. The penalty shall be as provided in Section 698.02.
