633.15 WASTE DISPOSAL SERVICES.
   (a)   No person authorized to engage in waste disposal services or garbage collection shall provide such services in such a manner as to create unnecessary noise. For the purposes of this section, noise emitted by equipment shall not be deemed unnecessary or without justification if the person engaged in such services has, to the extent reasonably feasible in the judgment of the Administrator or his or her designated agent, incorporated available sound-deadening devices into equipment used in rendering those services.
   (b)   Notwithstanding the foregoing, no person authorized to engage in waste disposal services or making use of garbage loading and/or compacting equipment or similar mechanical devices shall in any manner create any noise exceeding the following levels when measured at a distance of fifty feet from the equipment when within 500 feet of a residential zone:
      (1)   On or after a date one

      (3)   Impulsive sounds must not exceed the levels specified in division (a) or (b) of this section by more than five dbA unless the person creating them has filed an application for a variance in accordance with Section 633.19.
   (c)   Whoever violates any of the provisions of this section is guilty of a minor misdemeanor. A separate offense shall be deemed committed each day during or on which a violation occurs or continues. The penalty shall be as provided in Section 698.02.
