(a) No person shall have in his or her possession any spirituous liquor, as defined in Ohio R.C. 4301.01, in excess of one liter, in one or more containers, which was not purchased at wholesale or retail from the Ohio Division of Liquor Control or otherwise lawfully acquired pursuant to Ohio R.C. Chapters 4301 and 4303, or any other intoxicating liquor, in one or more containers, which was not lawfully acquired pursuant to Ohio R.C. Chapters 4301 and 4303.

(b) Whoever violates this section is guilty of a misdemeanor of the fourth degree and shall be subject to the penalty provided in Section 698.02.
