452.13 PARKING DURING PERIODS OF SNOWFALL.
   (a)   In order to facilitate the cleaning of streets and to expedite the free flow of vehicular traffic, motor vehicles shall not be parked on any city street at such times as the United States Weather Bureau records indicate that two inches of snow have fallen and there is a prospect of further snowfall. All vehicles parked on streets prior to the time weather conditions prohibited parking must be removed by the owners or operators thereof. Any motor vehicle parked in violation of this prohibition may be removed at the order of the Chief of Police or his or her designate, and may subject the owner or operator to the fines provided herein.
   (b)   The owners or operators of motor vehicles shall ascertain whether weather conditions require the removal of their motor vehicles from the streets and shall remove all cars parked in violation of this section. While the City will make every effort to inform the public of the existence of weather conditions requiring removal of parked motor vehicles from the streets, the owners and operators of said motor vehicles shall have full responsibility to determine existing weather conditions and to remove the parked vehicles if the weather conditions are such as to require their removal under this section.
   (c)   After the United States Weather Bureau records indicate that two inches of snow have fallen and there is a prospect of further snowfall, the Chief of Police or his or her designate may order the removal of all vehicles parked on city streets which have not been removed by the owners or operators. Such vehicles shall be removed to a motor vehicle pound as designated by the Chief of Police. Records shall be kept by the Police Department of all vehicles removed.
   (d)   In addition to the penalty provided in division (g) of this section, where a vehicle is towed to a motor vehicle pound, the car can be recovered only upon the payment of the towing charges imposed.
   (e)   The Police Department shall use all available means of disseminating information as to the existence of weather conditions requiring removal of parked motor vehicles from city streets. Such notice shall be disseminated through the radio, newspaper and all other available media to the extent feasible. However, the dissemination of this information shall not relieve owners or operators of motor vehicles from the responsibility of ascertaining the existence of weather conditions requiring the removal of parked motor vehicles from city streets.
   (f)   Parking is prohibited on streets in the City after two inches of snow have fallen and there is a prospect of further snowfall. No person shall fail to remove a parked motor vehicle when the weather conditions described in this section require its removal.
   (g)   Whoever violates any of the provisions of this section is guilty of a minor misdemeanor and shall be subject to the penalty provided in Section 408.01.
