(a) If the damage to a sidewalk was caused by action of the City in raising the grade of the street higher than the sidewalk level so that the sidewalk damage occurred, or if the damage to the sidewalk was caused by trees approved by the City, in the right-of-way by growth of roots, then the City shall pay 100 percent of the cost of the repairs.
(b) The City shall notify the owner of the need to replace or repair sidewalks where the damage to the sidewalk was not caused by the City as set forth in subsection (a) hereof, but where the repairs are necessary because of deterioration of the sidewalk from time and use. If the owner fails to repair or replace the sidewalk within thirty days, the City of Northwood may make the necessary repairs or replacement of the sidewalk at the property owner's expense. The property owner will be assessed 100 percent of repair cost. The City may make the repairs or contract for the repairs to be done by an outside source.
(c) The Sidewalk Commission and Hearing Board shall make the determination of the priority of sidewalks that should be repaired by the City, where the damage is caused by the City as set forth in subsection (a) hereof, so that the repairs can be made based upon the priority list as determined by the Commission.
(d) If private property owners have requested repairs and have deposited 100 percent of the estimated cost with the Finance and Revenue Director, the City shall make such repairs on a first-come and first-serve basis according to available City funds as appropriated in each calendar year.
(e) All sidewalks shall be made to the specifications of width, grade and depth of the concrete over both walk areas and driveway areas according to the plans approved by the Municipal Administrator.
