880.10 INTEREST AND PENALTIES.
   (a)   All taxes imposed and all moneys withheld or required to be withheld by employers under the provisions of this chapter and remaining unpaid after they become due shall bear interest at the rate of one percent per month or fraction thereof.
   (b)   In addition to interest as provided in subsection (a) hereof, penalties based on the unpaid tax are hereby imposed as follows:
      (1)   For failure to pay taxes due, other than taxes withheld: the greater of one percent per month or fraction thereof, or five dollars ($5.00) per month or fraction thereof;
      (2)   For failure to remit taxes withheld or required to be withheld from employees: the greater of five percent per month or fraction thereof, or ten dollars ($10.00) per month or fraction thereof;
      (3)   For failure to file necessary tax returns, ten dollars ($10.00) per month thereof; and
      (4)   For presenting a check which is dishonored for any reason, fifty dollars ($50.00) per dishonored check.
   (c)   Upon recommendation of the Commissioner of Taxation, the Board of Review may abate penalties or interest, or both, or upon appeal from the refusal of the Commissioner to recommend abatement of penalties or interest, the Board may nevertheless abate penalties or interest, or both.
