(a) Whoever violates any provision of this chapter shall be fined not more than ten thousand dollars ($10,000). Each day during or on which a violation occurs or continues shall constitute a separate offense.
(b) Upon a second or subsequent conviction for a violation of any provision of this chapter, the offender shall be fined not less than twenty thousand dollars ($20,000) nor more than fifty thousand dollars ($50,000) per day of violation, or imprisoned not less than two years nor more than four years, or both.
