838.04 NORTHWOOD HAZARDOUS WASTE LANDFILL ENVIRONMENTAL PROTECTION FUND.
   There is hereby created a fund to be known as the Northwood Hazardous Waste Landfill Environmental Protection Fund, which shall be the depository of all of the permit fee proceeds generated by this chapter. Such Fund shall not be used for any General Fund purpose of the City but shall be used solely to protect the public health, safety and welfare of City residents, for expenses directly related to the operation of the hazardous waste landfill facility, including, but not limited to, the following items: to provide sufficient funds for the City to pay the specialized and local costs of providing adequate fire and police protection in connection with the placement of hazardous wastes in such landfill; to provide funds for proper monitoring of litter control with respect to the trucks utilizing the roadways to the hazardous waste landfill; to provide funds for road maintenance for the weight of the trucks utilizing safe roads to the hazardous waste landfill site; to provide funds for necessary insurance premiums for liability insurance for the City for potential future claims against the City resulting from the operation of the hazardous waste landfill; to provide funds for engineering, legal and other professional services necessary to monitor the operation and results of the operation of the hazardous waste landfill site to ensure that all State and Federal regulations are being fully complied with; to provide funds for scientific analysis of surface water and/or ground water contamination during the operation of the hazardous waste landfill; to provide funds for monitoring air pollution resulting from the operation of the hazardous waste landfill site; and to provide funds for other expenses directly related to the operation of the hazardous waste landfill. If State law is amended and a fee or tax is levied on hazardous waste or solid waste facilities or local governments are authorized to levy such a fee or tax, and the proceeds of such fee or tax should go to the City for purposes similar to the purposes enumerated in this section, the permit fee established by this chapter shall be credited toward the payment of such fee or tax.
