838.03 IMPOSITION OF PERMIT FEE.
   There is hereby imposed a permit fee on all hazardous waste disposed within the City in accordance with any State permit. The fee shall be as set forth in Chapter 208 of the Administration Code - the General Fee Schedule. The fee shall be paid monthly to the Finance and Revenue Director of the City, based upon the monthly totals of hazardous waste disposed of at the facility located within the City limits according to the manifests filed by the operator of the hazardous waste landfill with the regulatory agencies and according to such other methods of determining tonnage as may be agreed upon by the City and the facility operator.
   The permit fee shall be paid by the twenty-fifth day of each month following the calendar month for which the report is filed.
   If any proper Court of record ever challenges the amount of the permit fee imposed by this section, such fee shall not be reduced below the amount set forth in Chapter 208 of the Administration Code - the General Fee Schedule - by any Court order, in compliance with the decision of the Supreme Court in the State involving the Fondessy Enterprise Landfill, which Court found such amount for hazardous waste deposit a reasonable fee.
