(A) Permitted days and hours. A person commits the offense of discharging fireworks if he or she discharges fireworks except during the period beginning at 12:00 noon on June 28 and ending July 4 at 11:59 p.m. of each year. Fireworks may be discharged only during the period of time between the hours of 12:00 noon and 10:00 p.m. on June 28 through and including July 3; and between the hours of 8:00 a.m. and 11:59 p.m. on July 4, except that a person may discharge fireworks at times other than those times designated in this division upon obtaining a permit to do so, at a location specified in the permit, which permit shall be issued by the Bureau of Fire Prevention if approved by the Mayor and City Council upon application.
(B) Prohibited locations. It shall further be unlawful to discharge fireworks within 100 feet of a fireworks stand. It shall further be unlawful to discharge fireworks in or on any public streets, parks or other property owned by the city, unless approved by the permitting process provided for in division (A) of this section.
(C) Penalty. Any person who violates this section shall be guilty of a misdemeanor and shall be punished as provided in § 130.999(A)(1).
