(a) When property comes into the possession of the Village Marshal that is unclaimed for a period of ninety days or more, and if the property involved is not required to be disposed of pursuant to the Ohio Revised Code or the Ordinances of the Village, the Village Marshal may contribute the property that is unclaimed for ninety days or more to one or more public agencies, to one or more non-profit organizations no part of the net income of which inures to the benefit of any private shareholder or individual and no substantial part of the activities of which consist of carrying on propaganda or otherwise attempting to influence legislation, or to one or more organizations satisfying Section 501(c)(3) or (c)(19) of the Internal Revenue Code of 1986.
(b) In the event the Village Marshal elects to contribute property to a qualified public agency, non-profit organization or other organization as permitted by subsection (a) hereof, the Village Marshal shall first obtain the written consent of the Mayor as to the specific agency or organization to whom the Marshal intends to contribute the property.
